Mid-July of this year, per the 2022 WI Supreme Court decision in "Doubek v. Kaul" invalidating the "domestic violence" enhancer to WI 947.01 "Disorderly Conduct, I had an FFL run both WI Handgun Hotline and Federal NICS background checks and I was "passed" on both. I also applied for and received a CCW license.

At that time, my CCAP report had a one-line entry for a 2010 Disorderly Conduct arrest and conviction under WI 947.01. The charge was stated as "Disorderly Conduct/DV".

I checked my CCAP this past week and found that the entry had changed. The 947.01 charge is shown with no "DV" and below that is an entry for "Modifier" 968.075(1)(a) "Domestic Abuse". WTF, why would that change 15 years after the fact? And after the Supreme Court clarified the issue?

Fuck OPSEC, this has my brain fried. Here's a link to my CCAP report:

I have no clue why that change was made or who made the change. And no clue as to if it is a gun-ownership prohibiting charge. One local FFL said "no worries" if DOJ has not pulled my CCW license. I've read that the Feds look at things a bit differently and that it could be a problem.

Another oddity: The home-based FFL that ran the background checks was visited by ATF who asked to see only the 4473 that I filled out. ATF told the FFL not to run checks if not actually selling a gun.

I asked to talk to the ATF person and I'm thinking of calling WI DOJ to talk to them. I thought this was a once-in-a-lifetime "get out of jail" thing but that CCAP entry looks problematic.

I would say this is something that you need a lawyer to ask. I think the state did some changes a couple years ago on the CCAP records formats.

I'm fairly sure the change occurred just recently because when I checked it a couple of months ago, it was the same as it had been since 2010. The change seems to have occurred since I applied for and received the CCW license in mid-July.

I'm hoping someone here has some insight into it. Lawyer is "Plan B".

After following your posts concerning this matter, I agree that it would be worth consulting with an attorney. A request by a representing attorney to the Illinois DOJ on legal firm letterhead is going to get faster results than a phone call inquiry. Just my opinion.

My opinion? The "other resident" is stirring the pot. This shit doesn't happen all on it's own.

Lawyer up... and while you're at it, if you discover that my above opinion is correct, then GTFO of that relationship for good.

That's one item on a short list of possibilities.

Lawyer, yes, I need legal help anyways for some related issues.

I will find out, possibly tomorrow, if the recent CCAP entry is actually a problem.

It is interesting that the last journal entry is in 2017, but they obviously changed it more recently if you just looked at it a few months ago.  The current record appears that you orginally pled to the Domestic abuse charge, not the disorderly, which is concerning.

Another background check was submtted late in the day Saturday. It's Tuesday now and I'm waiting for results. Will be interesting one way or another. I was told there will be a visit from ATF if it is a "fail". If so, I hope they can explain what changed from being "clean" 2 months ago til now.

Just notified that the background check is OK. So, it appears that the recent CCAP entry, however it came to be there, is not a disqualifier. That's a huge relief! I think I will buy something new to "celebrate".

Ccap is a weird thing.   All but one of my incidents have been removed over the years, so I presumed time.   The one remaining should have dropped off years ago if that was the case.   Why that one is still there, a mystery.

I'm thinking that the additional entry on my CCAP was done by the DOJ, triggered by the background checks and CCW application mid-July. What it means and why they did it are puzzling but, as it turned out, it's not prohibitive.

I'd really like to know but I'm not about to "poke the bear" at this point, just SMH and go my way.

My bullshit from my insane divorce fell off about a year ago.
I had to have my attorney push the state to drop it off of CCAP.
I got my NFA stuff back from the ATF 2 years before the CCAP fell off. It's strange that the state was way slower than the feds.

I do have to again, thank you and Brian for putting my club membership in limbo for the duration of my personal hell.
One of the days I'll have a range trip!
