It was announced this evening during the hearing that lowers will not be subject to SB25-003 licensing program. That is massive! |

My understanding of the bill was that it prohibited the "assembly" of most semi-auto firearms. So given a pre-owned lower, it would be easy to argue it was acquired pre bill so already (possibly) assembled and so no problem. But if you buy a lower after the date and then assemble it to a forbidden form the gov could try to screw you by arguing that you assembled one and broke the law. Maybe I'm wrong, but this seems just enough freedom to allow a nut job who plans to shoot up a school to aquire an AR (albeit technically unlawfully). But not enough freedom to allow a law abiding type to not risk prosecution for carrying the same AR around. You buy a lower, then get caught with it incorrectly assembled, and face a court case. Nut job buys an AR, assembles it to a forbidden form, breaks dozen other laws, and bingo we need more gun control. Or maybe I just a pessimist

Taken from another thread was able to find it, unfortunately, it seems rather ambiguous. The DOR spokesman said "they (lower receivers) fall under the definition of a firearm, but they are not a specific model, and the statute refers to models, so as far as the guidance document that we are going to be presenting, lower and upper receivers will not be on that document". Here's the problem, the context here seems to indicate that he's talking about the list of SSFs that section 7 of SB-25-003 required the DOR to publish, but that document is just *guidance* for the public, it's not law in itself. From my reading, it seems that even if a firearm isn't included in the DOR's guidance document's list of specific models, it can still be an SSF if it meets the definition in 18-12-116(c). As for whether that includes a lower receiver itself with no upper, that's a different question. Worth mentioning that the bill does create an exception for .22 caliber semi-automatic rifles, with that exception specifically not including firearms with separate upper/lower receivers, which courts may interpret as showing legislative intent to avoid loopholes built around upper/lower receivers. We'll probably just have to wait for the case law to come out before we can be sure. |

It's all fine and good to discuss what the law says, what CPW says, differences in meaning, definitions, technicalities, misinterpretations, etc.. At the end of the day when you walk into a gun store to buy a specific part and they don't stock it because of SB25-003, it really doesn't matter. Will firing pins, bolts, recoil springs, extractors, etc be on the shelves? Will lowers be for sale? Will product actually exist to purchase? It doesnt matter what technicalities there are, gun stores don't generally have the capital to fund numerous lawsuits against Colorado to fight the wording of laws. Gun stores will have to comply 100% with whatever they're told or risk their business license, FFL, and heavy fines from Colorado's state government. Sure you can travel out of state to buy certain things, making it an extra few hours of travel time. This will cause people to buy less though, put off major purchases due to inconvenience, and still eliminate new pistol and NFA platforms from their ability to purchase. |

The easy answer is to buy now, then you know your good. I would not put much faith in PSA shipping anything post ban. They were glaringly silent on the thread about demanding ID in store, then refusing mag purchases for the guy with a maryland ID. Even though such purchases were legal. Also, I'm not sure about actual gun stores, but the big box stores by me seem to be clearing out anything that may be impacted by the bill. No lowers, few ARs and no where near the normal stock of other semiautos. It could be they are just sold out, but as the gun dept looked dead I think if you don't own it by Aug 1st you won't. |

| Chances are now quite strong this is a temporary setback. After the ruling against NJ's bans (mags and "aw"s) rumint is they intend to appeal to SCOTUS, which is fairly friendly these days. Either the NJ appeal to SCOTUS will shoot down similar bans across the country, or worst case the CoA ruling can be used as extremely recent precedent in the lawsuits dropping 2 august. |

Picked up a lower this weekend and the guy in front of me at Triple J was picking up a Sig SBR of some sort. He told me the staff at TJ told him that the NFA guns like SBRs won't be subject to SB3, and he could have elected to get it after the law goes into effect. That sounded like bullshit. What say you guys? |

I got 4 and 1 year old boys and bought a full set of everything they might need starting out that will be affected, assuming that over the span of their childhoods future opportunities to purchase will diminish locally and then nationally. Each gets a: Integrally suppressed TD 10/22 Backpacker Suppressed M&P 15-22 pistol 2A Armament Balios Lite And choice of either SCAR 17 or POF Revolution. I'll figure out the handguns next year. I plan to train them how to shoot on the 10/22s, then M&P, then 2A ARs and eventually they get the small frame POFs when they're strong enough. And no, I'm not looking to adopt anyone.

Which is why the FFLs you've spoken to are weirdly unenthused about risking their businesses to transfer a lower to someone acting like a spoiled brat about it all. /shrug if you're all about breaking the law because it's a bad law, why not just drive out of state, use cash to buy a boatload of 80s and a jig, and bring them back here and mill them out? you'd get to try your hand at creating case law, and you wouldn't be demanding someone else put their own ass on the line just for you. win/win. |
