NJ is not over yet.  The Third Circuit en banc decision remands the case for further district court proceedings.  And even that is going to be delayed, as the NJ AG is almost certainly going to ask that the Third Circuit mandate be stayed while the state petitions the Supreme Court for a writ of certiorari.  NJ citizens are probably still a couple of years away from being able to walk into a gun store and buy an AR-15.  Justice delayed is justice denied.  These government officials need to be held personally liable.

Freedom Outdoors (formerly Colonial Shooting Academy) on Broad St should be GTG. I saw a video last week, they were the only store in that area that was outright going against the ban prior to the injunction going into effect. I'll make sure to spend some money there the next time I'm in the area.

GT has really gone downhill over the years.

I switched to DK Firearms in Bowling Green as my go-to two years ago.  The "bro" clique that a few of them had going on at the pistol counter convinced me to look else where.  They would see buyers waiting around up to +20 minutes and do everything to avoid having to wait on them, but as soon as one of their "bros" came in, they would run over to the counter to help them.  Then they had the tranny (who was a long time employee) decide to make their transition I believe over a single weekend.  Left on Friday as a male, returned on Monday in cosplay.

Green Top had a used Kimber 2K11 at the same price as the pistol, in new condition, at DK Firearms.  DK Firearms has a great selection for a small b&m family owned GS.  Their prices are better than Green Top for the same items, and DK did have more stock for magazines, etc.  If they did not have an item in the store, Lynda will order it for you with a deposit.  She was able to sell me a 300BO upper for my Rattler less than what I could find online, and less than MSRP.

Green Top had minimal shoppers when I picked up my suppressor transfer.  A group of the pistol counter employees were talking about "how to stay busy by wiping down the counters, going back and forth to the stock room in the rear", etc.  I asked one of the employees who has been there for atleast the past three years what Green Top was going to do with the injunction, and he said that they had not received any guidance from management.  I am not surprised that Green Top took this position.

Their offerings on Gunbroker appear to have significantly increased over the past two weeks.  I get emails every other day, so I assume this is how they are hoping to survive.  They definitely are not getting the in-store traffic that they used to.  The main parking lot used to be consistently filled, now there are plenty of spaces to park.

Curious to see what their Outdoor Expo will look like this fall.  A decent amount of the previous vendor attendees will no longer have their products supported by Green Top.  Daniel Defense is no longer involved, surprised to see Sig is sticking around.

The move follows weeks of legal back-and-forth over the constitutionality of the law and the scope of a Washington County judge’s temporary injunction. The court clarified that the order applies statewide, preventing enforcement of the ban across the commonwealth.



“This is a very good day for us here in Virginia,” said Del. Tim Griffin, R-53rd District, who called the ruling a win for Second Amendment rights. “They are limited in their power. They’re only allowed to do what the Constitution grants them the power to do. And they keep exceeding that. I’m hopeful that this will be a good sign to them that they need to slow down.”

Former U.S. Attorney for the Western District, John Fishwick, said the clarification makes the order clear for buyers, sellers and law enforcement.

ABC13's Allison Mullet asked, "Would you say that they can feel confident in their decision to buy or sell starting today?"

“Yes. I think this judge’s order is clear. That statewide you can’t be prosecuted for the sale of an AR-15. That law for the time being has been found to be unconstitutional,” Fishwick said.

Del. Sam Rasoul, D-38th District, urged patience as the case continues. “Let the court process play out to ensure that the constitution and our laws have a fair day in court,” he said.

The attorney general’s office sent a statement in response to the injunction taking effect, saying:

“The United States Supreme Court is reviewing challenges involving assault weapons bans that could directly inform these cases. Staying the four pending lawsuits will support the equal and fair application of the law and prevent conflicting outcomes. Virginia’s constitutional assault weapons ban was passed by the General Assembly and signed by Governor Spanberger to reduce gun violence and keep families, law enforcement, and communities safe. These protections are critical, evidence-based tools to protect public safety. We believe this legal path will produce a consistent process, and we remain confident that this lawful measure will ultimately be upheld.”


The injunction remains in effect until July 21, 2027, or until a final court decision is issued.

Just an FYI to the folks in Central Virginia, the Bass Pro across from GTSR is "back to normal".  They are working to get the larger capacity mag sku's back in the system for the registers to process the transaction.  The rep behind the counter said they expect that to be resolved by tomorrow.   No issues with AR transactions, etc.

The way I understand it from what other people have said, is that the Va democrats passed a law to make it so that manufacturers or retailers can be sued in civil court even though the assault weapons ban has been stopped at the moment.
If somebody uses a gun to do something criminal in Virginia, manufacturers/retailers can be sued. And that's why these companies are still cautious.
Most anything can be fixed with sticks and rocks and string.

Analysis: The Lingering Legal Liability in Virginia’s Enjoined AR Ban

AR-15s and 30-round magazines are back on store shelves in the Old Dominion, but the state’s “assault firearms” ban may still present a risk to buyers and sellers.

On Tuesday, a statewide injunction led many stores to begin selling those guns and magazines after a three-week hiatus. Those stores’ decisions are backed by state and national gun-rights groups, the gun industry’s trade group, and major national gun brands. There’s a strong consensus in the gun world that AR and magazine sales are lawful, at least for now.

But that doesn’t mean the situation is stable, especially given the details of how we got to the current legal position.

The sales restart was kicked off by an injunction that Judge Jeffrey L. Campbell of Virginia’s 28th Judicial Circuit first issued three weeks ago and then expanded to cover the entire state on Tuesday. But it’s important to understand the nature of that preliminary injunction. As the name implies, it isn’t a permanent ruling on the merits of the law.

While it does block anyone in Virginia from enforcing the law, it doesn’t actually invalidate the law. At least, not yet.

Certainly, the bar for getting a preliminary injunction is quite high. The judge has to determine the law is likely to be found unconstitutional before issuing one. The odds a judge who does that and then finds differently during the merits stage of the case are near zero, especially if the facts of the case don’t really change in the meantime–as should happen here.

Nonetheless, Virginia’s “assault firearms” ban remains in place at the moment. It can’t be enforced, but buying and selling the items it prohibits remains technically against the law.

That doesn’t matter much so long as the injunction, which is currently slated to remain in effect until July 2027, remains. But if Judge Campbell reverses himself on the merits, or, more likely, a higher court overturns his decision or even just stays it, that would put those who bought or sold ARs or other banned items during the injunction in a potential predicament. The law has yet to be invalidated even if it is enjoined, and anyone “who imports, sells, manufactures, purchases, or transfers an assault firearm” during this period could, at least in theory, be prosecuted for doing so if enforcement of the law is ever revived.
But Virginia isn’t the first state to find itself in this exact legal situation, and what’s happened in those examples is fairly instructive for how real the risk is for Virginians currently buying and selling ARs.
The most famous analogue for what’s currently happening in Virginia comes from California’s “Freedom Week.” In 2019, United States District Court Judge Robert Benitez determined the Golden State’s ban on magazines that hold more than 10 rounds was unconstitutional in a merits ruling. His ruling invalidated the law for about a week before he issued a stay, and an appeals court ultimately reversed his ruling–the exact same sequence happened again four years later after the Supreme Court of the United States (SCOTUS) granted, vacated, and remanded the still-unresolved case.
What happened during that week in 2019, though, is very similar to what’s happening right now in Virginia. Buyers flooded into stores, which were more than happy to sell them the momentarily unbanned magazines. By all accounts, it was a selling frenzy, and the continuing legality of the magazines purchased during that time hasn’t often come under dispute.
But that was a situation where the law had been fully invalidated, not just enjoined.
Illinois, on the other hand, saw US District Judge Stephen P. McGlynn issue a preliminary injunction against its AR-15 sales ban, the Protect Illinois Communities Act (PICA), back in 2023. As with Judge Campbell’s order in Virginia, Judge McGlynn’s initial order enjoined law enforcement officials from enforcing the ban. But the block ended six days later when an appeals court issued a stay on the decision and subsequently overturned Judge McGlynn’s injunction.
Unlike in California, though, law enforcement officials in Illinois have directly disputed the legality of “Freedom Week” sales.
“Persons who possess a banned firearm or firearm attachment are required to endorse an affidavit by January 1, 2024, stating that any banned firearm or firearm attachments were possessed prior to the enactment of PICA (January 10, 2023) pursuant to 720 ILCS 5/24-1.9(d),” the Illinois State Police told The Center Square that year.

In practice, though, there has only been one publicized case between the two states that deals with guns or magazines a defendant claimed he bought during a “Freedom Week.”
In March 2020, police arrested 27-year-old Pheng Yang for possession of a 15-round magazine in violation of California’s ban. The Tulare County District Attorney’s Office filed felony charges against him. But he ultimately prevailed in court, though that was largely because Judge Benitez specifically stipulated that those who bought magazines during “Freedom Week” were protected from prosecution in the stay he issued.
“The fact that this Petition succeeded is not remarkable. What is remarkable is the failure of the Sheriff and the DA’s Office to honor the Lawful Order of a Federal Judge,” Eric Schweitzer, Yang’s lawyer, told KFSN after the case was dismissed. “Sworn court records prove they received that Order not to arrest or prosecute several months before they arrested and prosecuted Mr. Yang in clear violation.”
It’s pretty evident at this point, despite the Illinois State Police’s determination, there is little appetite for trying to prosecute people who bought unbanned items during times when the laws were paused–whether through an injunction or a final merits ruling. Even the Yang case arose from police finding what at that point was a re-banned magazine while searching his room in an unrelated case, and “Freedom Week” only became relevant because that’s when Yang claimed to have bought the magazine, and the prosecutors apparently couldn’t prove otherwise. That’s likely to be the case in Virginia if enforcement of the ban is ever reinstated.
While Virginia Attorney General Jay Jones (D.) has insisted the AR-15 sales ban is constitutional, he hasn’t threatened prosecutions of those currently buying or selling ARs during the injunction. Instead, he’s asking the Virginia courts to pause their cases and wait for a SCOTUS decision that may ultimately make all of this moot.
Virginia’s court system is harder to read than its federal counterparts. It was no surprise when the Ninth and Seventh Circuits ultimately upheld California and Illinois’s bans given their ideological makeup and track record on Second Amendment challenges. The gun rights track record and ideological leanings of Virginia courts are less pronounced.
Still, what little case law there is suggests the Virginia Supreme Court may be deferential to SCOTUS on gun-rights questions. While AG Jones thinks that deference should come in the form of stays on the injunctions against the law, it’s easy to see the courts going the opposite direction. It’s entirely possible they leave the injunctions in place pending whatever SCOTUS ultimately decides.
“The United States Supreme Court is reviewing challenges involving assault weapons bans that could directly inform these cases,” he told WSET.
That’s perhaps an understatement. SCOTUS is poised to decide on the constitutionality of AR bans nationwide by this time next year. So, the underlying drama around Virginia’s ban is likely to be short-lived, even in a scenario where the Virginia courts don’t wait on SCOTUS.
If, as most experts expect, SCOTUS rules that AR bans are unconstitutional, any prosecution for buying one will most certainly be dismissed and any conviction overturned. It won’t really matter at that point whether enforcement of the law had returned in the interim. SCOTUS will have the final word one way or the other.
Of course, just because SCOTUS is likely to invalidate these laws by the end of next June and there’s little sign anyone is chomping at the bit to track down and lock up those currently buying ARs in Virginia, that doesn’t necessarily mean there’s no risk at all. In the unlikely event that Virginia courts decide to get ahead of SCOTUS, allow the ban to go back into effect, and an enterprising Commonwealth’s Attorney brings charges against somebody for violating it during the injunction, it’ll be a very unpleasant and costly experience for that person–as it likely was for Phen Yang despite him ultimately prevailing.
So, the risk seems fairly low if you agree with the consensus that SCOTUS is going to strike down AR-15 bans. And you can see why most of the gun world is confident enough to restart sales. But even if the risk is approaching zero, it isn’t quite there yet.

Katz’s lawyers argue the gun rights groups cannot make that showing on behalf of their members, and the motion quotes Virginia case law saying a lawsuit filed by someone without standing is a “legal nullity.” In other words, if the court agrees, the case would be treated as if it never legally existed.

The Supreme Court has frequently scrutinized the ripeness of pre-enforcement challenges to criminal statutes. The Court has explained that, when challenging a criminal statute, the plaintiff need not first expose himself to actual arrest or prosecution. Rather, it is sufficient for the plaintiff to allege that he (1) intends to engage in constitutionally protected activity prohibited by the statute and (2) faces a credible threat of prosecution. If you read the opinion the judge issued when he granted the temporary injunction, he already found that the organizations lack standing.  He went forward only with the individual plaintiff.  Given that preliminary ruling, it is not a big stretch to ask him to dismiss the claims brought by those plaintiffs.  It should not affect the claims by the individual plaintiff.

ETA:  The federal constitution has nothing to do with state court standing.  Completely different bodies of law.

The way I look at is that the democrats have said exactly who they are and what they are going to do. Any republican is going to be better than having the democrats win. So the Republican who has the best chance of defeating the democrats is who I vote for. I don't see any situation in the current circumstances where having the democrats win is good as a protest or to teach republicans a lesson for not meeting all of my wants and needs. If the democrat win we lose. Particularly when it comes to guns and specifically black rifles.

Unfortunately, voter turnout was the lowest in memory, only 2%!  😞 YIKES!

If we are going to move the needle at all in the right direction in Virginia, we really need to get conservatives engaged to vote in the November General Election.  As voters in the Virginia's 11th Congressional District, in November you will be voting on 5 things altogether: 2 people and 3 VA Constitutional Amendments.

           2 PEOPLE

   The US Senate race - BERT MIZUSAWA (R) vs. incumbent Mark Warner (D)
   The VA 11 Congressional District race - ARTHUS PURVES (R) vs. incumbent James Walkinshaw (D)

   3 CONSTITUTIONAL AMENDMENTS proposed by Gov. Spanberger & Richmond's Democrat controlled legislature
   Amendment 1 (unlimited, unmonitored, unrestricted abortion through all 9 months)
   Amendment 2 (codifies gay marriage and introduces transgender verbiage, thereby threatening the rights of those who oppose gay marriage and the transgender movement)
   Amendment 3 (part one: felons regain automatic right to vote/serve on juries immediately after serving their sentences, part two: lower the bar for mentally challenged individuals to vote)

   The Republican Party of Virginia position: Vote NO on all 3 of these onerous amendments.   In a future email I will outline in greater detail why these amendments are harmful for the people of Virginia and should be voted against.  This will take some explaining because once again, the ballot wording is intentionally confusing/misleading, just as we saw in the wording on the ballot for the Special Election on Gerrymandering our beloved Virginia.  Thank God the Virginia Supreme Court nullified the results of that fiasco!
