Not that I’ve heard of any problems with this in my state, but our legislature currently has a bill in the works that’ll make it a crime to refuse LE into a business armed (whether on duty or off duty). Like if an employee there verbally tells you, “You can’t have a gun in here,” that’ll be a violation. The max fine is $1,000.

I heard about it last week at Legal Updates training. I’m trying to find out if this also applies to the Superdome and Tiger Stadium. I’m hoping so.

EDIT: It was already signed by the governor in May, and became effective 8/1/2024. Act 38.

That'll be a tough sell, given private property rights and all. Not that I think people should refuse service or admission to armed law enforcement but, making it a violation is unconstitutional. Seems wiser to just not patronize them. They obviously have no choice if it's for official purposes.

Had a mental health facility try that here. I told my guys to turn around and leave as it wasn't that serious then.

That policy quickly changed and we are now "allowed" in the facility armed.

I'd find a new doctor that supports law enforcement. But if it were me. No way in hell would I be going around in public wearing a badge and ball-cap with a visible gun if not on official business.

I spent about 8 months in CID. Generally wearing slacks and a polo or button down shirt. In the office or when going out for official business visible badge and duty weapon in a paddle holster. Any other time I switched to pocket carry and stowed the badge.  Especially when going out for lunch or running a personal errand.

I retired ten years ago then for several years worked Public Safety (no gun) at a major trauma hospital.  I suggest you talk to their Chief  and politely explain your concerns. We often had on duty LE armed respond to calls or come for emergency treatment. In the ER there were gun lock boxes available and Security had portable hard pistol cases. People who are armed get injured and transported to the ER. We would secure civilian pistols and later release them to the owner in the parking lot as they were leaving.  I have had injured officers temporarily store their firearm by their own choice in the locked gun box in ER they hold the key ( like at a jail gun box).  There was only one time that I stepped in and told an off duty deputy that I needed to hang onto his weapon and that was because he was in the ER covered in his sisters blood and visibly loosing it because of her injuries from a motorcycle accident. He had been following on a second motorcycle when she as passenger got hit by a car. I knew her parents really well, I had been at their wedding. That was a bad day. So there can be circumstances where an officer should not be armed but certainly not the norm.

NC Deputy here. It’s my understanding that no place in the county which I have jurisdiction can tell me I can’t have my firearm.

If I’m a Deputy in county A, I am legally and technically always on duty in county A. Doesn’t matter if I’m at work or not. My Sheriff would also take himself to that office and explain to them why they are wrong. YMMV.

If you live in a different state YMMV, I can only speak to NC.

Might want to verify that with a statute vs. it being "your understanding".

I acknowledge your "If you live in a different state YMMV" statement. I'd be interested in what you find.

Being ON DUTY and performing a call for service is one thing, being off duty armed on private property is another.

Where I am, private property rights trump off duty agency policy, always has, always will. We all know cops who got into hot water because of what they "thought" was lawful and correct.

ETA- the major entertainment places here in central FL are the biggest anti-gun folks when it comes to officers ON DUTY but NOT on an official CALL FOR SERVICE on their property. That's why I suggest you explore a statute or official state supported legal opinion/statement that supports your understanding. Always better to have verified knowlesge BEFORE it's needed.

It’s somewhere in 17E, reference that OP.

It’s never an issue I’ve ran into here because it’s not a problem we face here in this particular county.

I’d assume based off your experience you are somewhere around Raleigh.

“It’s somewhere” doesn’t cut it.

Our badge doesn’t give us much over a citizen when off duty, especially on private property or outside our jurisdiction.

It’s not an issue here for the most part other than what I posted.

There are some good YouTube videos of cops  on duty but not on a call getting run off private property.

Don’t think your credentials entitle you to you to go where you want when you want because they don’t necessarily do.

You can speak to FL however you so desire. In NC if I’m a Deputy specifically in the county I’m sworn I can carry wherever I so desire. Whether I’m 41 or 42.

YMMV.

I'm seriously asking for an education here... your attitude is part of the problem today in LE. How long have you been on the job?

I just breezed through Chapter 17E... please point out to me where it gives you authority to dismiss private property concerns while not on duty and on a call. Point out where it gives you total carry authority at all times under all circumstances.

I hope you're fully aware that even if you are on duty and respond to private property for a call you can be told, not asked, depending on the circumstances, to kick rocks. If not, you might want to seek some legal advice, training, and education before you end up on a YouTube video yourself.

You're not citing ANY lawful statute to back up what you're saying and I'm simply asking for you to cite the statute that grants you such authority so I can actually learn.

ETA- The OP posted about being ON DUTY but NOT on a call and being asked NOT to carry on PRIVATE PROPERTY... whether he or anyone else likes it, that's the right of the business and any other private property owner.

A lot of cops need to get over themselves and realize their badge and credentials don't mean they can do what they want when they want... that is an undisputable fact that many in the career just can't grasp.

I've been at this for about 25 years... I learned early on I heard, I thought, and they said get me nowhere when shit goes south. I learned to KNOW the laws and rules and where to cite a reference if need be. I suggest you consider doing the same.

If we're on duty,  we have to go to the "clinic." Off duty is to your own doctor.  Unless they find out.  Then you're ordered to the "clinic."

You should have your sheriff call the head of the clinic and explain the officer safety issue this creates and ask them whether they are willing to accept the liability that this exposes them to.
