TLDR I have a friend in Memphis that needs help.

Situation:
42 year old single mother on disability income for legal blindness with 9 year old child. Shares a house with a 65 year old male and his 41 year old “girlfriend”

She is embroiled in this messy codependent situation that has been deteriorating for the last 2 years.
“Girlfriend” exhibits multiple drug using/ seeking behaviors. Has made threats of calling CPS/ getting her arrested. Has damaged or outright taken some of her personal property, is using some sort of spyware to illegally monitor her cell phone and her kids tablet.
We suspect that she has stolen medications to include adderall, smokes in the house, has some kind of drugs in the house. She will pick the lock of Mom’s bedroom door to rifle through shit. Has damaged the property and carved satanic symbols and threats into various parts of the house. Mom and her daughter have had unexplained scratches and cuts they have woken up with. Multiple rounds of unexplained illnesses and have noted food and drinks have tasted funny.

This person has priors for writing bad checks and tampering with or destroying evidence in the past as well as losing custody of her own child for substance abuse and abandonment reasons. She tries to claim she was military police and aided in multiple investigations that can’t be substantiated. Her record sounds dubious at best.
The “girlfriend “ is not on the lease for this house. The mom and her child are as well was the 65 year old man.

She’s trying to have her removed and get an order of protection and didn’t get any help today from whoever she talked to with MPD. I’m trying to figure out what i can do to help but I’m out of ideas and resources. I suspect this person has warrants in TX where she came from. She has multiple aliases and records for pretty much all of them. Does anyone have any suggestions on how to get this person out?

Everywhere is different.  Contact the country court and ask them the process where you are.  

Also, having warrants anymore is 50/50.  So many places refuse to extradite it’s not even funny.  Depends on the county and charge though.

With all three on the lease an eviction probably isn't going to happen if the BF wants the GF there.

About the only thing that would work for an eviction is an act of Domestic Violence against the mom or her child, or some serious Child Abuse incident.

"Household Members", which is what many states refer to the relationship as, generally are not evicted due to minor offenses committed against other household members... DV being the exception.

Having the BF on the lease mucks things up pretty bad.

ETA- also, to support an eviction in many places requires hard proof such as police reports, etc. Word of mouth and unfounded accusations are not going to cut it. Every allegation you make will be refuted and denied by the BF.
That's why nothing has been done.

Easiest solution is a temporary restraining order against the girl. Here you get them in district court. Eventually they'll both go to court and have to plead their cases. May be hard to prove if its just both their word.

Evictions are filed in city court here. But if her boyfriend wants the girl around and claims she doesn't live there full time. That's gonna be a dead end.


IMO the best solution would be if she could break her lease and move away from them. At the end of the day if her 'room mate' wants shitty drug addicted girlfriends to move in. There isn't anything she can do to stop it. She can get restraining orders. But lets be real here, you need actual evidence/documentation.

These people are worse than cockroaches. She can do just enough to cover her tracks but there’s physical evidence of their devices being tampered with and she’s been posting shit on facebook mocking the roommate indirectly as well as saying things that were almost directly out of a conversation we had last week where they would have had no way to know what was being said unless they had some kind of listening device in the phone. My phone even started acting up the moment she came in the door. I’ve told her to just pack her shit and get the cats re homed and GTFO.
