[ARCHIVED THREAD] - Selling "Assault Rifle" to CT state (Page 1 of 3)

I'm thinking about selling my HK MR762A1, but unfortunately, the buyer is in CT state... home of nasty AWB.
The buyer told me that he's a active duty military police and can purchase any "assault" firearms & "normal" capacity magazines as if he's in any other "free" state. He further stated that he could send me a copy of the statute and I could also verify it with his FFL if needed. I thought only official duty weapon is allowed to purchase even for active duty military and a letter is often issued by Commissioner prior to possession. The buyer told me that no such letter is needed. I'm not familiar with crazy CT state gun laws and not sure what to do. Should I tell him adios~ or is it legal to sell and ship it to his FFL? |

My opinion has always been that if it goes to an ffl what happens after that is not my problem. Others will say why assist a ban state cop in buying a playtoy gun when he's enforcing unconstitutional laws against others? If you are in some way uncomfortable it's not worth the trouble and just forget about it. |

I have a serious problem with the legislature that passed the law and the governor who signed it. |

Guy got arrested in ny selling to an Undercover trooper. Cop waited until the safe act passed and you had to use an ffl, set up a face to face of a gun, then arrested the guy. Ny state just sued for people shipping toy guns into Ny that were the wrong color. |

I believe the laws of your state says that whoever ships or causes to be shipped, etc, etc. is guilty of a felony. |

Related question. Can a CT civilian purchase a pre-ban AR? That is to say, someone pays an out of state seller to send it to their FFL in CT and they go pick it up? Yes. Thanks. I wasn't sure if the post-newtown changes to the law made it illegal to do so. |

If you or friends have old ARs or any pre 94 rifle (or pistol) collecting dust in your safe, we are always hungry for more. If you want to be a super cool human being, something that has been done in the past is you pick any high end super cool lower of your choice, and "trade" that for your pre-ban lower. Magazines need not apply, those have no exceptions. |

Quoted: Interesting, I stand corrected and will eat my slice of humble pie. CT is most definitely the exception to the rule, though. Case in point, I'm stationed in MD and live in VA because the gun laws closer to work are ![]() ![]() ![]() Join the Rebellion, send us ur pre banzz and we will love you. 4 ever. |

I'm a CT FFL. He's not lying. The way the law is written LEO an MIL can buy assault weapons. LEO needs a letter from the chief. MIL doesn't need anything. Thank you. The amount of parroted derp in the thread was oppressive. When I sell a firearm, I always stipulate that I will not do business with anyone in states like CT (can't remember who's on the list right now, it's getting longer. I have it on file). The purpose of the transaction when I sell is to make money. Usually to buy another firearm. Since I have NEVER had a problem finding a buyer in a free state, I feel NO need to research the bizarre gun laws of places like Connecticut or New York, or call anybody's Attorney General. Oppressive derp? Are you kidding me? There are AT LEAST two dozen free states in this country, places where men and women see firearms as tools to hunt, compete, and defend themselves, places like Wyoming, where this right, and preemption, is written in to the State Constitution. We are buying and selling firearms every day, without looking over our shoulders. WHY should we bother with you? When I list a firearm I occasionally get emails crying about how I won't deal with someone ("It's perfectly legal!"). When I bother to respond it's to point out that, last time I visited their state, their government hadn't yet built a fence around it to keep people in. This, from a guy who grew up in Brooklyn, and is doing very well in Wyoming. |

A federal agent enforcing a state law? Quoted:

What if it's an undercover ATF agent trying to entrap you. A federal agent enforcing a state law? Seems like we got a lot of Feds getting involved in state matters these days, depending on politics (google "Ferguson"). I have no intention of enrolling in Law School to try and figure it out. I don't have to. when I have a firearm to sell I can ALWAYS find a buyer who doesn't live in a place like CT. In fact, I sold a handgun last fall. Deal went down in a parking lot. At night. Cash and a handshake. I forget the guy's name. Perfectly legal in Wyoming. Probably multiple felonies in CT. |

Military, active, guard, reserve, doesn't matter, are fully exempt. Hell, I'll even do the transfer for him. |

No duty use clause in our law. His being an MP doesn't mean anything either. MOS, branch of service, it's all irrelevant. |

FPNI. We do not have equal protection under the law in CT. If he's active duty he can buy it for personal use. Doesn't have to be a duty weapon or anything like that. That is correct, active .mil can buy anything they want. Active has nothing to do with it. Active, guard, reserve, or state military forces are exempt. But you know this.

yes all is true. i would make sure the buyer includes his military id when buying That would be a violation of federal law. It's on the FFL, if you want him to confirm, have him email you from his military email address. It's on the FFL to confirm his military status when he does the transfer. |

Can you post either the statute number or a link to the military exemption? I cant seem to find it in writing and getting stationed in CT in a few months and trying to find best option for my assault guns. My research says I have to register my stuff in 90 days to keep it. http://www.ar15.com/forums/t_8_26/534071_F_A_Q__CT_is_this_legal_thread_and_helpful_links.html&page=5#i6482555 |
