I had created my eforms account about 1 week ago. Monday I walked into my LGS and they happened to have the SilencerCo Hybrid 46 DTM. We quickly worked out a barter where if I gave them something called "money", they would give me the suppressor. The clerk obtained my prints, data, assigned name for eforms, and my PIN, and submitted it electronically. On Wednesday I received my notification from eforms that I was go, and walked back into the store and claimed the suppressor. I was surprised because they had me do an ordinary 4473 (electronically submitted) and bingo it was done. Here's my question: I am very aware of the injunction by the court in Texas regarding certain NFA items and the "tax stamp" being rendered mute by the fact there is no longer a $200 tax. What was the "go" signal to the various gun stores that proceeding with 4473 was okay? I'm in Florida so our state laws don't impede these sales. My question is not a political one, it's what allowed enough of a consensus to proceed like this? Monday I was form 4, Wednesday I was 4473. This is happening all over where state laws aren't limiting sales. |
| There is no universal “go signal” that I know of. There are a lot of shops that are still doing Form 4s because they are waiting on official guidance from the ATF. Some aren’t. They figure the injunction is clear enough, or they aren’t going to get guidance, or whatever. You’ll have to ask your dealer why, but honestly who cares? Just enjoy your 4473 can and move on. |

Just enjoy your 4473 can and move on. This. There are 2 local gun shops in my area that are selling suppressors with only a 4473....all the others are still doing the Form4's. Sounds like it's kind of "iffy" right now, and lots of places are just playing it safe. At what point will it not be "iffy"? Is there a certain time period that needs to go by? |

No offense, but you aren't understanding the process. You registered a silencer with the ATF under the NFA on a Form 4. They have your prints, photo, etc. In order for the FFL to log the silencer out of their A&D book, they had you fill out a 4473. They didn't run it through NICS, it's just for record keeping. What you are referring to is dealers who have elected to transfer silencers WITHOUT submitting anything to the ATF, just a simple 4473 that is run through NICS under "other". |

Dealer choice: In free states, each dealer independently decides which process to use. Some have switched to the GCA transfer process (no Form 4, no fingerprints, no wait). Others continue using the standard NFA/Form 4 process — including fingerprints and ATF approval. Check with your dealer directly to confirm which process they are following before taking any action. I'll say this, though: when I shot the Enticer L side by side on my 13" Galil ACE's, the Enticer L sounded almost exactly the same as the full sized Rhodie. |

Now finally it is nice having the ability to purchse over the counter with only the ATF Form 4473 w/NICS. In Texas if you're already an TX LTC holder when purchasing the background check is already complete. Some FFL dealers are choosing to continue with ATF F4s for silencer sales/transfers. Maybe before the end of the month the ATF will say the 4473 w/NICS odds all that will be needed. Really suppressors should be sold over the counter with no restrictions. On the shelf next to the safety eyewear and hearing pro. |
