It wasn't really meant as a legal argument, but simply a statement of what happens in practical reality. I'm not aware of any situation where someone was charged, much less sentenced, for what amounts to a clerical error on OAL. There's no evidence that's something you need to be concerned about, but it can very easily be remedied regardless. If it's getting into the legal details, the engraving example isn't quite apples to apples. On the majority of forms, you've explicitly stated and agreed to the markings you'll be putting on the firearm. Not every form is going to have 4H filled, but a good portion do. Arguably, that's part of your legal obligation that you've agreed to when you signed the form. On the other hand, it could be argued that OAL would often have to be an estimate by its very nature. You're being asked to provide the OAL of a configuration you can't legally create prior to the approval of the form. There's no reasonable expectation that in every case you could know the exact length -- outside of an estimate, best guess, or relying on unverified 3rd party information -- until you've actually 'made' the firearm. You can't expect someone to violate the law to conform to it. At that point, measuring or estimating incorrectly initially is, at worst, a failure to update the paperwork. It's not quite the same. That said, from a practical enforcement standpoint, I'd tend to agree with the above comment. I think you would struggle to find examples of someone being charged solely for failing to mark their gun, assuming it has happened at all. It's just not something you're likely to be charged with outside of maybe being tacked on with more serious charges. Of course, anything is possible given the right circumstances; if an individual officer is just intent on charging you, they will probably find a reason to do so. If it worries you, just fix it. |
