Federal Firearms Licensees (FFLs) must use this form to report all transactions in which an unlicensed person (i.e., non-FFL holder) acquired any combination of two or more pistols or revolvers totaling two or more at one time or during five consecutive business days. In 25 years of business I always got a different answer from every IOI on what the definition of 5 business days is. Has anyone else had that issue? Is it 5 government business days? Is it 5 working days? Is it 5 consecutive days? What if my store is open 7 days a week? When I switched locations last year I had to go through the interview process for the new FFL. That guy told me it was 5 consecutive business days that I was operating. I asked, if my store was only open 1 day a month and I sold 2 handguns to a customer 4 consecutive business days apart (4 Months) would I have to submit a multiple sale form? He said he'd get back to me. He never did. |

At the advice of my lawyers, I only offer illegal advice. Keeping that in mind, I had the same conversation with my last IOI. I am only open one day a week, and it's Saturday. She said "just use normal people business days, please" The logic on this is that multiple handgun forms include handgun sales from OTHER FFLs as well, so "normal people business days" would be appropriate. Whatever we individually or mutually decide is going to be wrong anyhow, since it is written vaguely. Have a policy that is defensible, and hope to never have to defend that. And I say that knowing full well of the tribulations you've had of late.

I was making software for a Teamsters Union benefit enrollment program. Eligibility started after 8 weeks. It took them 8 weeks to decide what 8 weeks was for the programming. No one was willing to to say what added up to 8 weeks- hours, days worked, weekends, calendar days, holidays, etc.. My policy to cover my ass has been to follow the ATFs definition of 3 days for NICS delays. If they define 3 days for NICS as not counting that day, weekends of holidays (whether or not my store is open) - that's my defense for "5 days" following their same rules. |

Is it 5 government business days? Is it 5 working days? Is it 5 consecutive days? What if my store is open 7 days a week? The "business days" are days the licensee conducts business. My business days may be different than yours, Schhels or Academy's. When I switched locations last year I had to go through the interview process for the new FFL. That guy told me it was 5 consecutive business days that I was operating. He's correct. Edited to clarify: If your business days are M-F, those are five consecutive business days. So a transfer on Friday is day 1, Sat/Sun don't count, Monday is day 2, Tuesday is day 3, Wednesday is day 4, Thursday is day 5. If your business days are M/W/F, you can't count Tuesday, Thursday, Saturday or Sunday because those aren't your "business days". Your "consecutive business days are M/W/F/M/W/F/M/W/F and so on. A transfer on Monday is day 1 and business day 5 is Wednesday the next week. My first IOI gave "Saturday & Sunday Only business days" as an example: Customer buys one handgun last Saturday, buys another one this Sunday.......you file a report. |

Here's what NSSF wrote years ago: Best Business Practices for the Timely Submission of Multiple Handgun Sales Reports .......Federally licensed firearms retailers are required to file ATF Form 3310.4, Report of Multiple Sale or Other Disposition of Pistols and Revolvers, to report the transfer of two or more handguns to the same person at one time or within five consecutive business days. The business days in this case are the days the retailer’s premises are open. By law, the handgun reports are due to be submitted to both the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the chief law enforcement officer (CLEO) for the location where the sale requiring the report occurred; e.g. the CLEO where the FFL’s regular premises are or the CLEO of a gun show location. The "business days" you list on your Form 7 application are supposed to be the hours you devote to your business. The form asks "Hours of Operation and/or Availability of Business Activity" They are not necessarily the same hours you are open to the public. ATF does not require a minimum number of hours, but wants at least one hour on the application. |

The IOI called me two weeks ago and was fine with waiting on me cuz, I was out of town for the national guard last week. The newest form 7 doesnt require any business hours if you are "gunsmithing only" I just put "appt only" in every box except the one day with evening hours. |

I do ours the day they receive them. Mail the form out the next day. It doesn’t matter if it’s the weekend or not. I submit it immediately. You know you have to do the form, why not do it immediately? Keeps me from forgetting. Just passed our annual inspection with no violations.

The one before that was in 2023 and two IOI's showed up at 10am ringing my doorbell.....my ATF hours are M-F 5-8pm, Sat 11am-2pm. I was at school. IOI called later and we scheduled a time for the inspection. Thats the only time they tried the "surprise" inspection. Actually just got done with a compliance inspection on monday. The IOI called me two weeks ago and was fine with waiting on me cuz, I was out of town for the national guard last week. ATF Dallas has always managed to schedule my compliance inspections the first week of school, I have eight weeks off during June and July, so they want to come end of August or early September.  The newest form 7 doesnt require any business hours if you are "gunsmithing only" "gunsmithing only" doesn't appear anywhere on the Form 7 |
