It’s been a minute, but I recall my IOI telling me something along the lines of not being able to buy threaded tubes commercially and then manufacture a suppressor with them, as since I bought them intending to make a suppressor, they’re already a suppressor or something along those lines.

Am I remembering that right?  

IE the only way to manufacture new suppressors is to start with raw material?  

Could I form 2 a can I made with a maglite body (or pipes, or whatever), or is the maglite already a suppressor because I bought it intending to convert it?

Many of these companies now require you to have a completed Form1 before selling you the kit.

I’m an SOT.  I kinda want to build suppressors for sale.  But don’t want to invest in a bunch of tooling.  

I suppose I just need to talk to one of the local guys that used to sell solvent traps (I know he’s an SOT) and see if he can make tubes and caps for me with a variance

No variance needed, he can sell you parts no problem. You just have to submit the form 2 once you've completed them. Don't forget the engraving.

I appreciate that LOL.  For proof, here's the ATF's thought on the matter:

Are licensed manufacturers required to mark subparts or minor components, such as end caps of firearm muffler or silencer when transferred for further manufacturing or repair?

No. Firearm muffler or silencer parts transferred between qualified manufacturers for further manufacture or to complete new devices, and firearm muffler or silencer replacement parts transferred to qualified manufacturers or dealers to repair existing devices, need not be marked at the time of transfer. Any new device completed with such a part must be registered by the manufacturer. See 478.12(b). A subpart of a firearm muffler or silencer that is not a component part of a complete weapon at the time sold must be identified by an individual serial number.  See 478.92(a)(1)(iv).

Do you think there's really much of a market / profit on selling low-tech maglite body cans? Unless I'm reading this wrong, and you've got an idea for some amazing guts that go IN these maglite tubes, I can't imagine too many consumers ponying up for a tax stamp as well as some bucks for an unproven-brand flashlight-body'd silencer. If I'm misunderstanding and you've got a better mousetrap, then no disrespect intended.

If the goal is to have some boutique cans with your name on them, I'd just go variance letter and have someone that's in the business of OEM'ing silencers make some decent ones for you. I don't know KGM's minimums, etc. but they have done a lot of private label work for other manufacturers (DD, Dead Air, FN, etc.)

I wouldn't even go variance for a rimfire, just buy parts (baffles, tube and end caps), assemble, mark, eform 2: Profit!  Of course, you would need to find an 07SOT that sells the components. If you do want to go variance, GSL has done that in the past.

Basically the last part means you have to serialize and form 2 the parts before you sell to a non-07SOT. For example, if you sell a baffle to a non-07SOT, it has to be serialized and form 2 as a silencer.
