I sent in my Form 1 for SBR to a PTR 9. I listed it as a short-barrel rifle . All dimensions, calibers , were specified as customary . I've done a total of 12 SBRs before so I didn't expect any difficulties . I get the approved form back with a beautiful $0 tax stamp on it but I think there are some issues. First, although the approved checkmark is given, there is no signature but instead there is a rubber-stamped " AUTHOZED NFA DIVISION OFFIC" In lieu of a signature by a human being. It's obvious the rubber stamp would have said "Authorized NFA Division Officer." But for some reason that didn't show. The second issue, which is more concerning, is that in the fifth Box where the applicant's federal firearms license, if any, is usually placed there is a red rubber stamp saying, "Per Section 921 of Title 18, USC, and 27 CFR 479.11, type of firearm is silencer." I don't know what the hell this means but certainly a PTR 9 is not a silencer. I did not attempt to make a silencer. Should I call them back and get clarification on these issues or is this the way the NFA is doing this nowadays? |

Sounds about right. They haven't done examiner name/signatures now for a couple years. I wager it was because we became crafty and started emailing them when there were issues since they all have standard convention emails using their names, and they wanted to stop people from figuring out how to contact them directly. As for the note about being a silencer, that's most likely just an error, there's been a lot of weird head scratcher stuff like that in recent times. Probably mis-clicks when populating forms with stuff or just incompetence from a new/undertrained examiner. I'd just not worry about it. |

Thanks for the replies. I've been doing SBRs for decades now but hadn't done one in the last 5 years so the approved form raised some concerns. I guess the stamped "signature" is the standard now, but the remaining issue is the rubber-stamp claiming the type of firearm is a silencer, even though this is a Form 1 SBR as declared in Question 4B. Next week I'm going to call and ask them to send a new form for the same weapon without that stamp. I imagine if I get stopped on the road and get asked for "papers" and they see the SBR is declared a silencer by ATF they will ask, "Where is the silencer?" The reason I went with the archaic paper system is that for Form 1s at the moment, the e-forms are taking twice as long to process versus paper, 69 vs. 38 days . And the reason that I chose to register this SBR even though in the near future we may not have to, is that there's still a possibility that interstate travel will be hampered if you don't register them. |

I know that for some e-forms the approval is within a week, as I've had Form 4s processed lately in that time frame. However Form 1s are definitely not a priority for ATF and take longer. |

Huh, my last three eForm 1s were 12 days, 9 days, and 4 days, all in August. |

My last 2 SBR eForms Form 1’s, one was two days (Taurus RPC) and one was less than 24 hours (Rossi R95). Attached File |

My last 3 or 4 were super duper fast way less than 1 month. I used to care about having a physical stamp, but I really dont care anymore. I got back a paper form that was approved, but with no physical stamp on it. Oh well. And if you get stopped, you dont have to produce your papers. I mean, I guess theoretically an ATF agent might stop you, but I doubt it. They're the only people you have to produce those papers for, but, you knew that already. Right? |

Eforms for form 1 are not taking 69 days, don't know where you are getting that from , they are only taking a day or two, even with a trust. Over on the NFA Reddit they have an approval tracker where people post their wait times. Recent posts for Form 1's, 5 days, 42 hours, 40 hours, 36 hours, 5 days, 7 days, 47 hours, 45 hours, 2 days, 3 days, 2 days, 51 hours, and 41 hours, Those are all reported in the last week. |

So their report is full of data three months old. Since lawsuit allowing many transactions to be completed on a 4473 without filling out a Form 4 the wait times have dropped to almost nothing. That was only a month and a half ago |

Oddly enough, those paper submissions were approved and mailed back quicker than eForm 1s submitted at the same time lol |

I spoke with ATF this morning, and they admit that even though the form was filled out correctly for an SBR, somebody inexplicably stamped "this is a silencer" designation on it. As far as the registry is concerned it is a silencer, which it's not. I emailed a copy of the form and it is likely they will issue a duplicate without the offending stamp. My hope is that even before I get the corrected form, the new revised NFA guidance will say that for SBRs there will be no need to have a Form 1 for interstate travel . |
