The courts have been shitting all over the PLCAA, but each time there was a thin string connecting the dealer to the buyer that got PLCAA protection denied. In all those cases, as in mine the plaintiff claimed the dealer "should have known". There was always something like a record of a phone call to the dealer from the buyer. The gun was shipped to the dealer under one name but another person picked it up. The buyer was a repeat buyer of the same gun numerous times, etc. In my case there is nothing. There is nothing connecting me to the buyer on any occasion other than the day the purchase was made. No phone calls, not texts, no emails, nothing. If the judgy denies my motion to dismiss based on the plaintiffs claims that I "should have know" that their daughters suicide was the "foreseeable result" of a legal sale a week prior - the PLCAA is done. Bullshit! She had unrestricted access to sharp knives, tall buildings and bridges, and medicine and chemical compounds which are known to be lethal, as well as unrestricted assess to open water and access to motor vehicles and tools the misuse of which are known to have lethal consequences. It’s actually quite insulting to women at large to insinuate they are not capable of making safe and reasonable choices, especially if it’s true. Had she been a citizen of Canada she could have walked into a hospital and requested medically assisted suicide. … More likely than not a person determined to commit suicide will eventually be successful. In actual fact the failure of the system lies in the fact that a pharmacist is not required to report the sale of specific medications used for treatment of psychiatric disorders in a manner which red flags the federal background check system and initiates a police investigation. |

Mr Johnson is it also your opinion that if no water existed anywhere on earth that there would never again be a drowning victim. … What about cars sir if no cars existed on Earth would we no longer have fatal car crashes? Nobody can reach a conclusion that she would not find another means to commit suicide. People are resourceful. Wouldn’t you characterize a person with her long list of accomplishments as resourceful? |

Johnson is my lawyer. He did a good getting their witness to explain how ridiculous his expert report is. That same exchange will be taking place in front of a Jury. Good luck with it. Expecting personal responsibility is a thing of the past. Nobody can reach a conclusion that she would not find another means to commit suicide. People are resourceful. Wouldn’t you characterize a person with her long list of accomplishments as resourceful? |
