It appears that it is now possible to fill out an electronic Form 4 on the ATF EFile website, from myself (not an FFL) to a dealer in another state. Does that mean we can now skip the double-FFL-hop when transferring to someone in another state, and do a Form 4 transfer directly to a dealer in the buyer's home state? Who fills out the Form 4 paperwork in that event? The transferor or the transferee? |

I've done it several times since the new EForm update. Only bad thing is when the buyer says their dealer accepts from individuals, the Form 4 gets approved, and then the dealer denies the transfer. Voiding the form was kind of a pain in the ass with EForms until I figured out how to submit what they needed. |

You always could, its nothing new. You F4 > in state FFL/SOT who F3> buyers FFL/SOT who F4 > to the buyer or You F4> out of state FFL/SOT who F4's> to the buyer. The problem was the receiving dealer accepting a firearm shipment from a nonlicensee (not all do) and method of shipping. UPS and FedEx wouldn't ship firearms for nonlicensees, USPS only allowed nonlicensees to mail rifles and shotguns. Who fills out the Form 4 paperwork in that event? The transferor or the transferee? The transferor fills out the Form 4 but will need the transferees info to do so. |
