I know ATF doesnt use logic, but just for discussion is engraving really needed any more? So there are two basic ways we get a SBR. There are factory made SBR that factory role marked and are not engraved (by us) and transferred on a form 4. In the past this is a very small percentage of the SBRs out there. Then the most common, probably 99% of what we have has been on form 1s where we engrave them. Up until recently most of these just stay on a form 1. They are role marked from the original manufacturer and then we engrave them with the info that is clearly on the form 1. Makes sense (stupid but makes sense). But now that there is no $200 transfer fee many of us (myself included) are moving some SBR/SBS from individual or original trust to one of our other trusts. That will put them on a form 4. I have not yet completed one of these transfers. So I could be wrong. But l imagine these SBR/SBS on a form 4 will have no mention of the original individual or trust that filed the original form 1. Obviously they will say who the transferors info but that does not mean that is the "maker". So how would any LEO or anyone looking at the form 4 know if it should be engraved or if it came from the factory as an SBR/SBS or if it has been transferred 10 times? I am assuming that the new form 4 will list the ORIGINAL "manufacturer maker" in box 4a. I could be all wrong on that. This came to my mind as I was filling out a form 4 for my "pistol brace" SBRs. They obviously are not engraved and dont need to be. But are currently on a form 1. Once they are on a from 4 in my trust it should be as if they were a SBR from the factory (which they were kind of) and I got them originally on a form 4. But then I realized that the pistol brace form 1 looks the same as my other form 1 SBRs that I engraved. So I assume the transfer process would be the same and the resulting form 4 would be the same. So how will anyone know which ones need engraving, which ones were "made" on form 1, which ones were "pistol brace", which ones were sold by the manufacturer as SBR on form 4s? Maybe I am thinking about this all wrong, correct me if I am wrong. I have filed about 20 forms but they are still confusing to me. I also know logic does not apply to the ATF. But does this sound about right? But SBRs probably didnt end up on form 4s as much in the past. Now I am thinking a LOT of them will end up on form 4s being transferred into trust or even being sold on the used market. |

It took me a minute to understand exactly what you're asking...that's an interesting question. What happens to a stamped Form 1 if you transfer it to a new owner? (Be it trust, or a completely different person). I would assume the ATF would have records and could hypothetically cross reference that to see if the specific SBR should be engraved or if it was a factory SBR. Won't happen, but hypothetically it could right? |

| I think the honest answer is “who cares?” If the engraving requirement goes away, it really doesn’t matter. If it’s transfered on a Form 4, it especially doesn’t matter. How it got “made” in the first place, factory made, pistol or rifle conversion, or “free” pistol brace SBR, all that was done by someone else before it gets to you on a Form 4, and they were responsible for engraving it or not. My for Form 1 SBRs, I’m betting the ATF, even under some wet fantasy future Democrat administration, has better things to do than look at dates and try to figure out who they can charge with not engraving a SBR that should have been engraved. Of all the things in this world to worry about, this isn’t one of them. YMMV. |

ATF comment period ended last month on their proposed rule change that would do away with the extra engraving on a Form 1 that already had a manufactures SN. Now if from a 80% then yes you still have to. Wait and see what happens. Couple others was dropping informing Chief law enforcement and spouse added to individual ownership (stops catch 22 when you die) |

To take it a step further what if you never assemble that Geissele lower with a barrel shorter than 16" after you get your form 1 back. At least at that time it shouldn't matter that it isnt engraved. Then you do the form 4 to your trust before you assemble it into a SBR. As much as it sounds like I am saying this is a way to break the law and get away with it I am not saying that at all. Just kind of pointing out how silly this all is. What if this lower doesnt get engraved when it is form 1ed and then you buy it used after the 3rd or 4th form 4 transfer between multiple owners. Are you now responsible for it not being engraved? How is anyone supposed to tell it should be engraved in the first place? Who the hell really cares?

I think opinion letters have been historically one of the most misunderstood and misused aspects of this entire industry. I issue/furnish opinion letters all the time when I’m in an acting capacity or in a management capacity for cases involving something unrelated to this. They mean absolutely nothing other than as a reply correspondence to the person I’m addressing and or as an official opinion statement from my capacity/position for why I made the decision I made in the case in front of me. They would only ever hold up if a district court allowed them to hold up and or wanted to press the issue. Regardless of what my Agency wanted to push or not push as we do not have any jurisdiction to override the willingness to prosecute or lack there of which is far more common. |

I know what the rules are though. |

| The only reason they started writing that on the forms before they sent them back was because of how many were not aware it was required. Just see the dozens if not hundreds of threads here and elsewhere with people arguing about it. Whether or not they include the note doesn't change the requirement. |

| Another hitch is that prior to recent rule changes (2020 IIRC) one could put Form 1 SBR maker’s markings on the barrel or upper receiver. That was useful if one only had one short upper amongst others > 16” or if one didn’t want to defile / mark up a sentimental lower. So with that & the brace ‘no marking’ allowance and factory SBRs, there are plenty of NFA registered lowers with no additional markings. |

First owner files paperwork [maker of the SBR] for SBR but does not engrave Sells to second owner who will fill out paperwork [buyer of SBR], logically copying the info from the seller's paperwork If there is a paper trail, the 'culprit' will be found if someone digs into it. |

There is a review period for a couple different persons/entities before a decision is made That is a question on a FAQ list when I went down that rabbit hole on the ATF and another government web site I also read a good portion of the comments about a week before it closed. Comments were mostly positive but not 100% positive There were a couple where someone was trying to open a whole new can of worms for 02/07 FFL's. What a tool. Just respond without making a fuss. Some people just can't help themselves. |

| After my last 3 or 4 coming back without any condition, all submitted after they had announced the proposed rule change, I just got one today that had the engraving condition. I’m guessing it’s probably only one examiner who is putting this on as a condition. That rule change can’t come fast enough for me. |
