Dude dropped off a gun a few weeks ago and hasn't come back to pick up the completed job.
yesterday I get a call from the county prosecutor asking if I have a firearm in my store that belongs to so and so.     I know its here, they know it's here. it's logged in my book, so I say, yes it's here.  He wouldn't tell me why he was asking, and I wouldn't tell him what it was.

I Google the owners name and he was arrested last week for aggravated menacing by stalking.

I'm assuming the victim told the police he had a gun, and when the police ask him where it was he told them I had it?

I have a call back to the prosecutor hoping he can give me more info regarding the guys situation.

I'm not giving him his stuff back until I get some proof he's not prohibited.   Which is fucked, but if I hand it back tomorrow and he shoots someone with it 2 days later I'm screwed.   That will be a "should have known" civil suit for sure.

Oh joy.

Call your Lawyer, ask if there is anyway to turn it over to the Prosecutor or LE, to cut yourself out of the situation.
Then if he does some dirty shit, you are clear of it.

I'm not saying you're in the wrong but how is he supposed to do that?  And I have followed your other situation so I understand the hesitation.
I only do retail so I am not 100% familiar with customer gun process but since you logged it in,  doesn't he have to fill out a 4473 and pass a NICS to get his gun back then he it should be out of your hands?

BigBore,  please hear me when I say that I mean ZERO disrespect by any means. You've always been good to me in previous exchanges but I'm just trying to figure out how you can hold his gun without getting flack.

There is no 4473 requirement on a firearm brought in for repair that is returned to the owner.  

It may be a hassle, and the dude may get pissed, but until I see a court copy of dismissed charges, and a lifted restraining order(how ever it works), I'm keeping it.

This is a solution. Depending on the state of he gets a DV charge he may have to turn over
His guns.  Maybe the gun is evidence in the case, so the DA can impound it and deal with it.

Which county arrested him? You should be able to check with their Clerk's office and get a copy of any TRO or Protective Order issued against the guy. It'll have a checkbox (or something) where the judge can prohibit possession of firearms.

You might see if LE where the guy lives accepts firearms for safekeeping. If they do, you could potentially turn it over to them. They can (and should) run anyone in NCIC before transferring a firearm to them, and of course it would absolve you if he later does something stupid with it.

Maybe change your written store policy, so you can later explain that you followed it?
"If customer becomes prohibited from lawful firearm possession, or the management has reason to believe they have become prohibited, customer's firearm will be transferred to LE having jurisdiction over the customer's listed address for safekeeping, and shall be documented as remaining the customer's property so that he/she may later claim the firearm." or something like that.

If you took your car in for an oil change and the dealer said he was keeping it but said he'd pay the wholesale value, would you be cool with that?  It's still his property.  But yes, I would love to buy even at full retail (which would be around $200).

I'm wondering the same thing.  If there is a police report for such, I can say I did what I could do but was forced to return the property.

It wasnt stolen. Customer willingly gave it to BB. Failure to return it is a civil suit at best.

This is where a solid unclaimed goods policy, back by state law can be your friend.

In the shithole of NY if a gun goes out and comes back through a FFL I am pretty sure they have to run another background check.   I think the only exception is same day service, like putting sights on.

I could be wrong.

Before I retired we had run a check before returning any evidence guns.   If you don’t pass the best we could do is allow a FFL of their choosing to come pick it up so it could be sold and the non background check passer gets some cash instead of having it melted.

In your shoes… I’d make sure he’s also not a dentist.
The only hyphenated names I like are cartridge names......30-06, 30-40, 38-55 etc.

Since the ADA called you I’d start back there for an all clear or better yet the court.   Obviously you’d need the ADA to tell you which court.
obviously emails are pretty good documentation when saved of course.

Also consider that he was/could be using your shop as a way to stash a weapon while he was doing criminal stuff, and doesn’t mind fucking you over.

I would want some follow up that the customer was not being charged criminally before handing it back to him- in writing from the DA.  They opened that can of worms, I would say as far as you know he will be charged (as is likely anyhow).  So you know he can’t take possession of it, until something changes.  

Most likely whatever your policy is for unclaimed firearms will affect how long until you take ownership of it to pay off your fees.  His problem, not yours.  

Honestly I did not realize you could take something in for gunsmithing overnight and not need to do a background check to release it.  Never needed to know that aspect I guess.  Makes sense, since anyone can mail something to a gunsmith or manufacturer, and they can mail it back directly.

Actually all restraining orders should be entered into your state system, which connects to the Federal NCIC system, which I assume is what NICS references.  

The only time a restraining order isn’t findable in a system is when it #1- has not been served on the person yet, #2- it has just been served, so it is valid, but has not been entered into the computer system yet, and #3- it got dropped.  Some variation of those is the only way they don’t show up typically.

No, it has to be something that would result in as the 4473 says something punishable by imprisonment of more than 1 year.  Ohio has different levels of felonies. You can be a convicted felon in Ohio for a crime that had a max sentence of 6 months and not be a prohibited person.

Sounds like Guilty while Mentally Ill.
The judge continued the case while asking for a competency evaluation, then let him go with credit for 19 days served, stayed all but those 19 days while slapping a monitor on him and ordering him to continue treatment.

I think the judgment refers to the weapon he was arrested with, not the one sitting here.
