I apologize because this has probably been asked a dozen times before, but my searching ability sucks and didn't come up with anything.

Does the ATF approve form 1s for grandfathered firearms or do they consider that a creating a new banned "assault weapon?"  

Being in VA, I'm just trying to get an idea if I should file now for anything I would contemplate Form 1ing in the future.

I would like the same answer.

Also it depends on weather the banning state considers the firearm that already exists and is grandfathered to be a NEW firearm if made into a SBR.

During the 1994 federal ban, a preban “host” gun could be a shortened in a preban configuration.  However, a postban “host” that got shortened had to be postban compliant.

Examples:  People bought pre-1989 AKs and had gunsmiths convert to SBR using then-dirt-cheap Krink kits.  Vector marketed “newly” manufactured Uzi SBRs with the stocks welded open and bayonet lugs ground off.

Note:  The original ban only grandfathered complete firearms.  Just having a lower wasn’t having a complete firearm.  Legally, the lower by itself was postban.  Could it ever be proven?  No, and plenty of no-name lowers magically transformed into completed firearms unless they were sold after the ban as a receiver.   That’s why those Group Industries Uzi receivers sold by Vector were all postban; even though they were made in the 1980s, they were all sold as stripped receivers post-1994.  See “Advice” below.

Exceptions:  Machine gun hosts because machine guns aren’t semiautomatic and AOWs because they technically aren’t handguns.  

Biggest headache:  Suppressors were judged to be flash hiders.  Plus threaded barrels were a problem.  The workaround was a permanently attached QD mount because a QD mount wasn’t a threaded barrel OR an integral build because that normally negated any threaded barrel concerns.  But on a postban build, you still had to be mindful of the suppressor as your one allowed evil feature.

Caveat:  Lots was learned by the antis in the 30+ years since drafting and passing the 1994 ban.  They may or may not adjust language to change how this would work with a modern ban.

Advice:  If you’re in a state with an impending ban, file NOW to avoid this issue entirely.  If you only have a receiver, you should also complete the firearm ASAP.  I’d personally prefer dated receipts of components to prove possession before any ban is put in place.
