| Texas FFL with lots of ARs and a table reserved at the Virginia Beach Gun Show looking for a friendly Virginia FFL to handle the paperwork. Law requires we do the transfer at the premises of your FFL so I would need to come there on Friday morning to do the transfers and "Consignment" paperwork. I feel like these promoter will put my table next to yours at which point it becomes an extra table for you more or less. I'll pay your transfer fees as we sell the guns and work for you over the weekend. I probably have between 50 and 70 ARS to bring with me. Genuinely want to see as many Virginians have these before the 1st as possible |

You may want to rethink. The VSP POC system for running background checks has been going up and down like a yo-yo over the past few days, apparently due to "IT issues / volume". Unlike TX, VA CHL holders don't get to bypass the background check. |

Since 2008, ATF Dallas has said I can't do that. I can display, take orders and accept payment at an out of state gun show.......but must return to Texas and ship the firearms to a licensee in that state. (I disagree with that opinion, being federal law and ATF regs don't dictate my method of transferring to an out of state dealer) It used to be the common practice at the Wanenmacher Show in Tulsa. TX dealer would transfer to a nearby OK dealer who would then transfer to the OK buyer. ATF says you can't do that now. Law requires we do the transfer at the premises of your FFL so I would need to come there on Friday morning to do the transfers and "Consignment" paperwork. What law says that? You can dispose to another FFL anywhere. You can acquire from another FFL anywhere. | There's actually a section of the law that requires FFL transfers to take place on FFL premises. Therefore transferring FFL to FFL at a gun show is technically not okay. It actually has less to do with interstate commerce and more to do with this other weird rule they have. If I can find a virginia-based FFL and catch them at their premises before the show that is where we will do the transfer and sign the paperwork. Then we can go to the gun show work the weekend and on Sunday when they go put their guns up at their premises I can help them and they can transfer any of my leftovers back to me on that premises. It's a weird way to have to walk around it but it's totally doable. As an employee of the company I am allowed to handle the shipping AKA transport I don't actually have to go through FedEx or UPS |

Consignment via a Local Virginia FFL If your goal is to have a Virginia-based FFL handle sales for you, this is governed by ATF Ruling 2010-1 and the overarching framework of the GCA. Under this policy: Letter of Agreement: You and the in-state (Virginia) FFL must have a consignment or temporary assignment agreement on file. Logging out: Before the show, the firearms must be logged out of your dealer bound book (A&D record) and logged into the Virginia FFL's book. Physical transfer: You must take the guns to the licensed premises of the Virginia FFL. There, the two parties must unpack them, jointly verify serial numbers, and re-pack them. The Virginia FFL can then bring them to the show location. |

In addition, records of firearms transactions conducted at such locations shall include the location of the sale or other disposition, be entered in the acquisition and disposition records of the licensee, and retained on the premises specified on the license. It actually has less to do with interstate commerce and more to do with this other weird rule they have.
