I live in freaking Idaho where guns are everywhere. Ive had a handful of friends all go out an purchase suppressors in the last two weeks. EVERY SINGLE dealer has made them do a form 4. NO OVER THE COUNTER 4473. Dealers up here wont even entertain it. And these are cans being purchased directly through Silencer Shop who expressly tell you that Idaho is a 4473 can friendly state. Silencer shop is sending cans as NFA items to dealers, which makes them say if it comes in NFA, It stays NFA even though they say differently on the webpage. Anyone else seeing this? Ive called a dozen shops and they all say the same thing, form 4 only. |

Zero guidance from ATF… who wants their dog killed or being sent to Federal pound me in the ass penitentiary? Even if it is for a short term? I’ve heard people complaining to the dealers about it. Me, personally, I did my Gemtech MIST-22 on a Form4 without hesitation. I’m Federal L/E, so getting jammed up for an NFA violation is not what I want to deal with. Once it is cleared, and there is no legitimate worry about prosecution… then I’ll consider doing it in another method. Sorry, but a free Form 4 with less than a week wait is not worth the risk to my livelihood. Now, do I think that it has been way too long for ATF to not put something out? Yes and no. Yes because it should be done to comply with the ruling, not drawn out. No because I know how long .gov takes to change things. |

You also gotta realise you last two are in TX, where the court presides over. Nobody else outside that jurisdiction wants to find out the hard way that they aren't covered. |

There are a few dealers in KY doing them on 4473's, I only know one personally. One of them is a pretty good friend of mine who did his first one this past Saturday after talking first hand with some shops who were inspected and passed. He also spoke to his examiner about it as well. There are still some odd things about it. For example when he receives a can from silencer shop and sells it on a 4473 that can is still on his books electronically. so If the person who bought it on a 4473 ever decided to sell it later on down the road it has to come back to him to get transfered on a form 3 to whatever other dealer. I do have a can coming to him probably sometime this week but I think im gonna ask him to let me do it the old way on a Form 4 this new process I dont completely trust yet. |

It was NFA the day it was completed by the manufacturer. 2. A Form 3 from Silencer Shop to the dealer is required because the firearm is being shipped across state lines. 3. That means it will show in the eForms inventory for the manufacturer, Silencer shop and the dealer. 4. Silencer Shop is working with ATF on a method to indicate that the silencer was transferred to the customer on a Form 4473 only, to remove the silencer from the dealers inventory in the NFRTR. |

Right now, the dealer indicates in his Dealer Dashboard if he processes his Silencer Shop sourced silencers via Form 4 or 4473 only. While its possible to toggle back and forth it creates notifications to every customer that creates confusion. Silencers sourced from other vendors and processed by the dealer are automatically routed through the Form 4 process. Its my understanding that SS is working on a process to allow the dealer to choose Form 4/4473 Only for specific silencers as the customer prefers. No idea when that will happen. |

He did order my can directly through silencer shop along with several more for other customers. I was curious if that toggle in the dealer dashboard was just there to let people know they were willing to do it on a 4473. I didnt know if it was a you pick which way you want to do and have to stick with that rule from silencer shop. I guess I can just message him to ask if I could do a Form 4 but I hate to bother him because I know he is a busy guy. |
