I have asked this on nfatalk form but haven't been able to get an answer and my neighbor is trying to figure out eforms to transfer everything to a trust because he's trying to get all of his affairs in order but he can't get any straight answers from the "ask the experts" contact at the atf. Some of this info may not have any bearing on any of this, but I'm going to pass it along as I heard and understand it because it may be important somehow. I'm hoping some of you may be able to give some advice that I can pass along to him to help him out. Back ~25 years ago, he had an FFL. I think he said it was on class 1. Or maybe he said 01. He said during that time he had bought a machinegun on a form 4 from an estate and paid the tax. He said the paperwork does list his ffl number, but it lists his name and address at the top and signature as the transferee. Said the form 4 was approved without problem and he still has a copy of it. This may or may not have any bearing, but the question was asked on the other forum, so I'll mention his answer here. He said he was a sole proprietor and not an corp. So everything I'm seeing is that he could keep the transferable. *It wasn't a dealer sample. He said he only mentioned his ffl on the form because he could receive the gun in the mail with it. That and I guess where he had already paid for his FFL and was on file I suppose. A couple years after all of that, he retired and closed his business and was able to keep the gun. Then a few years later, his wife retired and they sold their house and moved. He said at that time, he even sent the atf some kind of paper telling them he was moving and listed the machinegun and whatever else he had, and there was no problems at any time with any of it. Not with the original approved form nor problem with getting approval to move with it. He said but now when he tries to transfer it on eforms, he's aware that he would need to pay the $200 transfer tax still, but he said their computer won't let him submit the paperwork because it's giving him a "not in inventory" error. Despite that he says that he has the approved paperwork for it. So, I'm writing to ask if anyone here may know what he may do to get this fixed. As I said, he contacted the atf about it and this is what he forwarded to me and what they said. I'm going to paste this here in its' entirety though, I will be removing any personal info. -------------------------------- I'M TRYING TO FORM 4 TRANSFER MY MACHINEGUN TO A TRUST AND THE SYSTEM IS GIVING ME A NOT IN INVENTORY ERROR AND I CANNOT PROCEED UNTIL THAT IS CORRECTED ON YOUR END. MY FORMER ADDRESS WAS: omitted I HAVE SINCE MOVED AND NOTIFIED ATF OF SUCH AND THE CURRENT ADDRESS SHOULD NOW READ: omitted THE FORM 4 TRANSFER WAS APPROVED TO ME ON AUG 20, 2004. I AM ABLE TO FIND THE CONTROL NUMBER BY LOOKING UP THE SERIAL AND OTHER INFO ON EFORMS. IF IT HELPS YOU TO KNOW THAT, IT IS omitted BUT AS I SAID, WHEN I TRY TO INPUT IT INTO THE FIREARM FIELD, IT'S TRYING TO TELL ME THAT IT'S NOT IN MY INVENTORY, SO IF YOU COULD PLEASE FIX THAT I WOULD APPRECIATE IT. THANK YOU. --------------------- And their reply: --------------------- Good Morning, If you are an active FFL/SOT holder using your eforms account to transfer a weapon on a form 4, please make sure that at the beginning of the form when asked “What type of entity is the firearm being transferred from”, you are clicking the first option as FFL with SOT. This will allow for you to view the inventory on the firearm tab as usual, after clicking the add firearm button. Notice it now asks you to select what kind of transferor it is? FFL, Trust, individual, etc. At first you couldnt transfer from individual to ffl but they just fixed that too. The bigger problem would be that the neighbor likely doesn't have the machinegun on his eforms account. So paper would be easier anyway. The atf can add it, but its hit or miss. All my eform 4s have been right about 10 days since Jan 1st. Even trusts. |

Like all IT shops they were a little rushed to get the eForms application changes (more or less) working and into production by the deadline, so trivialities like documentation had to catch up later. |

It falls outside the common transfer so that makes the eform go haywire. Paper. As a FFL without SOT you can receive NFA items without fingerprint cards or photo but you must pay the tax. All of my NFA items have been received that way. Each time (after the first time) I included a letter citing the ATF regulation and a statement and each time it was denied. Then a phone call to correct them resulted in a speedy approval after the year long wait (18 months at times). They really have no idea how to handle that scenario. |
