Father shoots man pointing gun at son

A Buffalo man who was supposedly buying rims for his truck at a Liddell Street residence was shot about 11:15 p.m. Tuesday when he attempted to rob the seller, Buffalo police said.

Darius Spates, 23, of Northland Avenue pointed a gun at the seller, identified as Tony Winans, 21, of the Lidell address, and Winans' father, Tommy Travis, 44, of the same address, shot Spates, detectives said.

Spates, who suffered a gunshot wound to his forearm and underwent surgery, was listed in fair condition Wednesday in Erie County Medical Center. He was charged with attempted robbery, criminal use of a firearm, criminal possession of a weapon and menacing. Spates' alleged accomplice, Jamar V. Bailey, 25, of Bickford Avenue was charged with attempted robbery and unlawful possession of marijuana.

Travis has not been charged, Ferry-Fillmore District Lt. Joseph Lynch said.

Police say a Buffalo man fought back with a shotgun when three men
tried to rob him in his home. News 4's Jodi Hovenden reports one of
the suspected bandits is hospitalized with a severely-wounded arm.

"I was thinking he was going to shoot me."

It was an emotional and terrifying night for this 44-year-old Liddell
Street resident who fought back when police say one of three men who
came to his home to buy tire rims from his 21-year-old son shoved a
gun in his face.

Buffalo Police Lieutenant Steve Nichols said, "Once they started to
negotiate the rims, they pulled out a gun and stuck it in the kid's
father's face."

The father said, "He pulled a pistol and put it in my face, so I shut
the door, grabbed the shotgun, opened the door, and shot him."

Police say all three suspects took off, but 24-year-old Darius
Spates, who had been shot in the arm, only made it to Goodyear and
Broadway, where a bystander flagged down a Metro bus for help.

Spates was rushed to ECMC.

Police say the resident who shot him acted in self-defense.

Nichols said, "They were just some people defending themselves. They
had kids in the house, babies in the house. These guys pulled a gun
and stuck it in the guy's face."

Hovenden: Did you ever think you would have to pull out a gun to
protect yourself in your own home?

Resident: In this neighborhood, I think about it every day.

And he says he worries about it every day, wishing he could leave
this neighborhood where there are so many guns.

Resident: When I was a kid, not as many pistols were out here. Now,
all these kids got pistols.

Resident: I'm just trying to survive down here.

Hovenden: Do you think it is a similar feeling for a lot of people
who live in this neighborhood?

Resident: I know it is, especially for older people. It's the older
people and the good people who suffer.

Police say Darius Spates is in stable condition and is facing an
attempted robbery charge.

They have also arrested one of the other two suspects, Jamar Bailey,
and charged him with attempted robbery.

The third suspect is not in custody.

The father made three crucial mistake.  Only wounding one and missing the other two.

I'm pleasantly shocked both at the objective press coverage, and the lack of police prosecution, the shooter has received thus far.

I don't much like the interview in the end, it's almost as though the reporter is trying to make up for his (her?) objectivity by quoting people saying that guns are bad.  Was there really a reason for this?

Good up until this point.  But note it isn't quoted material, just hearsay.

So now the perp is recieving free medical treatment courtesy of the Erie County Taxpayers Association! Glad to help a person in need. This poor criminal could have been killed trying to steal those rims. Thankfully he is getting the care he deserves, and should be back up on his feet in no time!
