MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(e)


BILL NUMBER: A10090

TITLE OF BILL:  An act to amend the general business law, in relation
to requiring the registration of persons who purchase ammunition and the
creation of a data base


PURPOSE OR GENERAL IDEA OF THE BILL:

Provides that persons who purchase ammunition at retail shall register
with the seller and a statewide data base shall be maintained.


SUMMARY OF SPECIFIC PROVISIONS:

Amends the general business law by adding section 399-yy. This new
section requires that any individual buying ammunition at retail shall
be required to register information for a statewide data base at the
point of purchase. Section 399-yy defines what information is required
for registration. Registration will mandate the seller to include the
caliber, brand, and other vital ballistic information crucial for police
officers piecing together crime scenes. Also, crucial information about
the buyer will be included, such as his or hers legal name, address, and
driver's license number or photo identification card number. This bill
makes having a valid driver's license or non-driver photo identification
a requirement for all retail ammunition purchases.


JUSTIFICATION:

This bill will provide police officers a valuable tool to link guns from
various crime scenes and help protect New York's families. Each year
guns are used to kill 1, 200 New Yorkers. Guns are used in 50 percent of
all murders and since 1999 have claimed the lives of 7,000 New Yorkers.
Requiring the registration of individuals seeking to purchase ammunition
will help stymie New York's violent gun crime.  This new legislation can
be influential in addressing violent crime in a multitude of scenarios.
Police could use the database to search for individuals who purchased
ammunition matching the ballistic information found at the crime scene.
Eye witnesses could look through pictures of individuals matching their
descriptions. In addition, any information

found could be pertinent for prosecutors during trial. These are just a
few of the implications that this legislation could have.


PRIOR LEGISLATIVE HISTORY:

This is new legislation.


FISCAL IMPLICATIONS:

To be determined.


EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have
become a law, except that any rule or regulation necessary for the time-
ly implementation of this act on its effective date shall be promulgated
on or before such date.

         The People of the State of New York, represented in Senate and  Assem-
       bly, do enact as follows:

    1    Section 1. The general business law is amended by adding a new section
    2  399-yy to read as follows:
    3    §  399-yy.  Registration of persons who purchase ammunition; statewide
    4  data base. 1. For purposes of this section "ammunition" means cartridges
    5  or bullets intended to be used in revolvers, pistols, rifles, shot  guns
    6  or other guns.
    7    2.  A  person or entity which sells ammunition at retail shall require
    8  that the person purchasing such  ammunition  present  a  state  driver's
    9  license  or  non-driver photo identification card, and such person shall
   10  also register at the time of purchase.
   11    3. Registration for purchase of ammunition requires that the seller of
   12  such ammunition record the date of  purchase,  the  legal  name  of  the
   13  purchaser,  the  driver's  license  number  or photo identification card
   14  number of the purchaser, the address  of  the  purchaser,  the  caliber,
   15  quantity  and other identifying information available for the ammunition
   16  purchased, and the make and model of the firearm in which the ammunition
   17  is intended to be used.
   18    4. All information obtained at registration by the seller  of  ammuni-
   19  tion  shall  be  forwarded to the department of state in accordance with
   20  rules and regulations which shall be promulgated  by  the  secretary  of
   21  state.  The  department  of  state  shall maintain all such registration
   22  information in a statewide data base.
   23    § 2. This act shall take effect on the ninetieth day  after  it  shall
   24  have  become a law, except that any rule or regulation necessary for the
   25  timely implementation of this act on its effective date shall be promul-
   26  gated on or before such date.

So is this the same as California's ammunition serial number plan?

Regardless, what a waste of time and money.  I'm glad lawmakers aren't spending it on less important things like establishing some fiscal responsibility and attracting new businesses into the state to establish a better economy.

Some of our lawmakers have serious issues with straightening out their priorities.

And I'm quite sure that nothing else in NY is used to kill people...oh, I don't know, cars, knives, bats, etc?  Shouldn't you be going after drunken drivers or something?  Hey, let's decide to go after guns because they have a more politically attractive platform!

Guns are used in 50 percent of all murders and since 1999 have claimed the lives of 7,000 New Yorkers.   Ok, so what was used in the OTHER 50% of murders?  Why don't ya'll go after those other 50%, huh?  How many New Yorkers lives' have been claimed by traffic accidents, illict drug use, medical malpractice, suicide (suicide by gun I'm sure you're counting as a gun crime, rather than a straight suicide), etc?

Requiring the registration of individuals seeking to purchase ammunition
will help stymie New York's violent gun crime.  This will only serve to stymie law-abiding citizens NOT stop any sort of crime.  Must lawmakers always forget that criminals are ALREADY disregarding laws?  Enacting new laws does nothing to stop the criminals from going about their daily business.

The largest mass murder (killed 87 people) in NYS by an individual was committed by Julio Gonzales who set fire to a NYC social club with a gallon of gasoline.  

The "killed by gun" statistics usually include suicides, criminals killed by police, self defense killings by citizens and hunting accidents etc. They never tell you that.

How many lives have been saved by civilian use of firearms in NYS.

We'll never see that statistic because its almost impossible to formulate.

The NYS Assembly anti-gun agenda does not provide for the concept of self-defense. You are supposed to hide under your bed and call 911 on your cell phone while your wife and children are murdered.

CT's SB 304 in Public Safety Committee right now, would BAN POSSESSION of handguns based on EXTERNAL FINISH COLOR!!!! No grandfather clause.

Yup.... you heard it here first! external color. Not caliber, not capacity, not action type, not size or weight or barrel length, not material of construction, but........ COLOR.

Under SB 304 CT handguns must be and I quote : "Black"; "Nickel"; "Chrome"; "Gray" or "Military Camel" (not camo - CAMEL as in the animal)

Actually, the largest mass murder in NYS occurred on 9/11/01 when approximately 3000 innocent people were slaughtered by boxcutter wielding terrorist assholes.

But your point is well taken.

The 9-11 WTC attack and mass murder was committed by an organized group of terrorists and not "an individual" acting alone as was the case with Gonzales.

Fair enough.  I missed that part in your original post but you did specify "individual."  And you're right.

Again, to echo your sentiments, if you're going to blame guns for murders, you better blame gas cans, bic lighters, boxcutters and airplanes as well.  We're on the same page, you and I.

WOW, not even 1 "please don't hurt me hat"....This deserves at least a couple.

And the CT bill is the most ridiculous thing I have ever heard.  I thought banning the 7.62x39 caliber or Colt rifles was bad but this is going too far. Color? Not to mention you can't buy beer after 8:00 PM or on Sundays and holidays in CT but riding mororcycles without a helmet is A-OK. Whiskey Tango Foxtrot!
