IS this legal? Can a cop car or two park in your driveway to hang out or to use it as a hiding position while using a speed measuring device?

i see this one cop everyday on stewart avenue chilling out in various houses. He even was on some guys lawn last week. that takes balls right there.

I don't think they own the first 10 feet. they probably retain an easement to enter the first 10 feet to do repairs of sewer / water lines.

They should still ask permission. It good public relations. Most people would say yes.

If thats the case how come I have to pay to have my sidewalk fixed. They plant these friken trees and it F-ups the sidewalk has it grows. Told not their problem and I have to pay to fix it. So I asked them if I can cut the tree down. They say No it's their property and I better not touch it.

Now the tree is going into the telephone and power lines. Told not their problem that LILCO or Cablevision needs to deal with it. Then LILCO and Cablevision say not their problem...

Sorry got off topic..But I am pissed about this friken tree BS...Tell the cop he can park under it so when it falls it will solve a couple of problems.

Ask them for a PBA card since you are part of thier operation. On a serious note, call the desk Sgt. and tell him some people gave you crap about being part of the operation and you would appreciate not being connected with a speed trap. Diplomacy and bullshit goes far.

They are running speed enforcement details in your neighborhood because one or more of your neighbors complained about speeding cars. They usually ask permission to park in your driveway or on your property though.

Throw down some spike strips in your driveway if these pesky cops annoy you.

I always ask permission first as a courtesy. If it bothers you, call the agency. Maybe a former occupant of your property gave an officer permission and they don't know theres someone new living there, for instance. Most homeowners are ok with you sitting in their driveway if they are asked first.......

The last month of so Nassau cops have been crawling all over Elmont, in my hood mostly. They're going after people who don't do "full" stops at stop signs. Most of the violations happen on Rosser Ave, B Street and Kirkman Ave.

I've always got a huge police presence considering I leave 2 blocks away from the 3rd precinct. Anyone know how I can get increased enforcement on a specific stop sign? People blow through it like it's their job and there's usually a lot of kids in the neighborhood...

Usually, they ask permission from the home owner. Generally they are there because of community complaints/requests.
It doen't hurt to get to know the officer. Traffic duty sucks. You may make a friend on the force that could come in handy down the road. Especially if this guy gets traffic detail a lot. At least your house will not get robbed. Unless he is sleeping

Call up and bitch, or get some of the neighbors together and everyone call up and bitch.

Upstate you show up at the common council meeting and say "Why they go down Aimless Ave like bats outta hell! Little kids coming home from school will be squished if something is not done!" etc
then they stick a patrol car there for a few days

Aimless has it right. I have a stop sign right out fron that is mostly ignored. I wrote a letter to the 7th Precinct commander with a copy to police headquarters and had a sergeant at the house less than two weeks later. A week after that a PD was down the side street, watching the stop sign. Unfortunately, most to the drivers were let off as they claimed a tree ruined their complete view of the sign as they approached. Regardless, the letters got results.

Local cops use our driveway, both at home and at the shop where I work. Good thing I'm not paranoid.

That's cool with me because it's mostly during school open and close times and there are a number of gangs here. I don't know if I would want a speed trap, or checkpoint coming out of my house though. Neighborhood watch, looking out for the kids is great, but anything else I would expect them to ask first so I can deny permission and explain why.

A police officer in NYS has no absolutely no right to park his vehicle (or person) on your property for purposes of traffic enforcement. Ask the officer to leave or complain to a supervisor. Expect them to f*** you back in return.

Bottom line is it's illegal for any LEO to be on your property unless they involved in a law enforcement activity involving either a resident of the property, or the property itself. There are limited exceptions such as pursuit of a suspect, or an active investigation that requires a LEO to access your property to either question someone, serve papers, or attempt to collect evidence. Tagging moving violations from your driveway is right out. I know someone who came home one night to find a NYS Trooper running radar from his drivway. That ended right there.
