On behalf of our Board of Directors, our families, our children, and those West Virginians yet unborn, I cannot thank you all enough for your passion, dedication, and commitment in getting HB2694 passed by the Legislature. Let us review just what this historic legislation accomplishes:

(1) AFFIRMS THE RIGHT TO KEEP AND BEAR ARMS AS A FUNDAMENTAL RIGHT UNDER BOTH STATE AND FEDERAL CONSTITUTIONS.


(2) ASSERTS AND CITES THE CRUCIAL 'PRINTZ V. US' SCOTUS CASE THAT PROVIDES AS FOLLOWS: "Congress cannot compel the States to enact or enforce a federal regulatory program. Today we hold that Congress cannot circumvent that prohibition by conscripting the States' officers directly. The Federal Government may neither issue directives requiring the States to address particular problems, nor command the States' officers, or those of their political subdivisions, to administer or enforce a federal regulatory program. It matters not whether policymaking is involved, and no case-by-case weighing of the burdens or benefits is necessary; such commands are fundamentally incompatible with our constitutional system of dual sovereignty".


(3) EXPLICITLY AND STATUTORILY PROHIBITS COMMANDEERING OF STATE AND LOCAL LAW ENFORCEMENT BY THE FEDERAL GOVERNMENT


(4) PROHIBITS STATE AND LOCAL POLICE FROM PARTICIPATING IN FEDERAL SEARCH WARRANTS WHEN THE PROPERTY SOUGHT TO BE SEIZED IS LAWFUL TO POSSESS UNDER STATE LAW


(5) PROHIBITS STATE AND LOCAL POLICE FROM PARTICIPATING IN FEDERAL ARREST WARRANTS WHEN THE CRIME CHARGED IS FOR POSSESSING FIREARMS, AMMUNITION, OR ACCESSORIES LAWFUL TO OWN UNDER STATE LAW.


(6) PROHIBITS STATE AND LOCAL LAW POLICE FROM ENFORCING ANY RED FLAG LAW (WHETHER FEDERAL OR STATE LEVEL)  ALSO EXPRESSLY PROHIBITS AND DENIES ANY WV COURT FROM ANY AUTHORITY OR JURISDICTION TO ISSUE A RED FLAG ORDER


(7) PROHIBITS STATE AND LOCAL POLICE ENGAGED IN TRAFFIC STOPS OR NOISE COMPLAINTS (YOUR MOST LIKELY INTERACTION WITH POLICE) FROM DETAINING YOU AND HANDING YOU OVER TO FEDERAL AGENCIES FOR ANYTHING THAT COULD BE LAWFULLY OWNED AS OF 1/1/2021  (such as AR15s, full capacity magazines, pistol braces, et cetera)


(8) PERMITS THE CONTINUED COOPERATION OF STATE, LOCAL AND FEDERAL LAW ENFORCEMENT FOR NON-FIREARM RELATED ACTIVITIES SUCH AS DRUG TASK FORCES OR TASK FORCES THAT HAVE A PRIMARY PURPOSE OTHER THAN PROHIBITING FIREARMS LAWFULLY OWNED UNDER WEST VIRGINIA LAW.


(9) AUTHORIZES AND DIRECTS THE ATTORNEY GENERAL TO CHALLENGE FUTURE FEDERAL FIREARM INFRINGEMENTS IN THE COURTS.


(10) AUTHORIZES AND DIRECTS THE ATTORNEY GENERAL TO PUBLISH MODEL POLICIES FOR OUR WEST VIRGINIA LAW ENFORCEMENT BROTHERS AND SISTERS AS TO HOW TO AVOID FEDERAL COMMANDEERING.


(11) PROVIDES GOOD STATE AND LOCAL POLICE WITH IMMUNITY FOR REFUSING TO CARRY OUT FEDERAL FIREARM INFRINGEMENTS  INCLUDING A RIGHT TO NOT BE FIRED FOR REFUSING TO ENFORCE FEDERAL INFRINGEMENTS ON YOUR RIGHT TO KEEP AND BEAR ARMS
