Saw a slot on breakfast TV this morning with the parents of the murdered teenager Ben Kinsella talking about what happened to their son.

Their son was murdered by three scumbags, one was on bail for a robbery in which a man was stabbed 9 times, and another was under a supervision order for drug dealing. All had previous criminal convictions.

All were out causing trouble and Ben Kinsella, in attempting to walk away from trouble he wasn't even a part of, was chased and stabbed 11 times.

The minimum sentence for committing murder with a gun is 30 years.

The minimum sentence for committing murder with a knife is 15 years........... These wankers will be out and free before they are 35.

The message being, it's better to commit murder with a knife than a gun.....

...... the results are the same, the devastation caused is the same and it if you use a knife you need to be up close and personal...... there can be no argument that you didn't mean to kill the victim.

How is a knife any "better" than a gun?

Easy - laws are written by people who are just not very good at it.

And the sentences are dished out by judges who really dont understand what happens on council estates and outside nightclubs because they inhabit a world FAR removed from that inhabited by the victims and offenders.

And then politicans get involved looking for easy soundbites and easier votes.............

It's been against the law to kill somone with a knife for as long as I can remember......so the law was written a long time ago.

Sentencing guidelines change all the time..... based on what?

I think that it stems from the legality of the weapon and how they are viewed our ridiculous PC nanny state

A knife in itself is not automatically illegal or even restricted by licensing (even though it is currently illegal to carry one in a public place); however handguns are.

The feeling is that if you shoot someone with a gun; then you never had any other intention than to kill them and that you must be a professional criminal. Also, the guardianistas claim that some poor little inner city children only carry knifes because they are scared and live in poverty and so need them for self defense  - so they shouldn't be punished as it's societies fault.

The fact is that the judiciary are totally clueless - a magistrate recently stated in court that they didn't know what a doorman was.

The scum that stabbed that poor lad; should get exactly the same sentence as they would have if they had shot him. They are cowardly worthless scum who all have a history of criminality and violence. They stabbed that lad purely because they felt that had been "dissed" and so had to affirm their manhood by attacking someone at random.

They will never be of any use to society and it irks me that society has to pay for their up keep; when there is a much fairer and cheaper solution to the problem of their existence.

Based on the amount of prison space. They simply dont have enough prisons to give every criminal who deserves jail, a proper sentence.

This is why they try comunity service, tagging, ASBO, reprimands - everything BUT prison until they have to. If jail time was automatic for every offence we would need double the number of prisons to house them.

If life sentence actually meant life, we would need a lot more prisons too.

If I had my way - penal colony for the worst offenders - a bleak island off scotland - drop them there, give them air drops of food. No tv, no luxuries. We have the technology to keep it secure.

And chain gangs for the rest - prison should be discomfort and embarassment - not several years of doing nothing interspersed with eating and watching tv !!
