Every shop I deal with charges $10 because that's what the TBI charges. So I see this today and email them

Screenshots of emails as soon as I can get them to load but basically they said it's $15 because TBI charges them $10. WTF?
Well I can't get them to load.
I've never heard of an upcharge on the background fee, seems shady to me.

Back when Gun Shitty on Murfreesboro Road had an FFL, they charged $14 for the TBI check.

I've never heard of this. I personally would not give them any business because if they aren't honest enough about a $10 BG fee, then I sure wouldn't trust them to be honest about a used gun.

Legally they can charge whatever they want, even when it comes to the TICS.  Before going forward lets clarify some things. Dealers don't charge for TICS or for tax, they merely collect it for the powers to be.  To charge an additional fee is unwise. However, to charge a "filing fee" is not out of the question, and some of you know what I mean. Get denied and pay $30 (or whatever) $10 for the TICS, $20 for the filing of the paper work (this fee is included in the cost of the firearm).

ETA: If they're the only show in town then they may have you by the balls.

I have seen the 'thanks for wasting our time fee' ($10 fee for the background check if you are approved, $30 fee for the background check if you are denied) a time or two, and I understand the logic of it, but this thread is the first I can remember having heard of a dealer apparently collecting a fee to collect the state's fee for them.

My FFL is $15 extra for first item on transfer and then $10 for all others. It gives them a quick buck for not doing much work and draws me in to their "just came out of pawn" category. They know my tastes. I don't expect anyone to work for free.

I guess you don't mind getting $15 for change for a $20. Profit comes in the margin between what they pay for an item and what you pay for an item. The TBI charges $10 for the background check. The FFL only collects it, like sales tax. I see this as a fraud issue. What if your local sales tax was 9.75% but your FFL "collected" at 14.75%? Would there be an issue there?????

I am talking transfers from PSA, AIM Surplus, or Kentucky Gun Co. I don't normally purchase anything expensive locally due to 9.75% sales tax in TN. When I pick up a gun at my FFL, I have already paid for the firearm online. If he only charged me $10 for the background, then he didn't make any money and is wasting his time. So he charges $10 for background, and then $15 for the transfer, and $10 for any others on the same background check. If I actually purchase a gun off the shelf there, then it is gun price, plus sales tax, plus $10 background. Maybe that is a little more clear.

The OP isn't talking about transfer fees, though. He is strictly talking about the fee the FFL charges each and every customer to do a 4473 and call in the TICS check, even if the gun was an in-stock item. Essentially, if the price tag say $495; you are actually paying $95 for the gun, 9.25-9.75% for sales tax, and $15 for the background check. Whereas, most TN FFL's would have charged you $495 for the gun, 9.25-9.75% for tax, and $10 for the TICS check. What the dealer should do, and would do if he were smart about his greed, would be to simply add the extra $5 into the price of each gun. Rather than charge $495 for that gun, he'd charge $500. It would be smart because, if he currently sells 2 guns on the same 4473, he's only collecting $5 above and beyond what TBI charges him. If he added the $5 into each gun's price, he would make $10 more on each 2 gun sale, netting him $5 more than his current, and blatantly obvious, way of overcharging his customers.

I am NOT talking about transfers from another FFL but it would apply there as well because he would charge you his transfer fee, and $15 for the $10 TBI background check.
I'm talking you walk in the store and see a gun at a price you like and buy it. You fill out form 4473. The dealer gets his price, collects the state sales tax, AND collects 150% of the TBI background check fee. It's online or a toll free call that takes only minutes. I just think its cheating the customer, A surcharge to collect what is essentially a state tax on a gun purchase is unethical. what if he tacked his own 5 cent sticker next to each 10 cent state tax sticker and told you that was his fee for collecting the state fee?
I don't know how else to explain it........

Charging an extra $5 on an in house purchase does seem quite fucky. I wouldn't do business with him unless the gun in question was a steal. I thought that you were talking about transfers vs an in house sale.

You know that is a good question.

I'm reading FFL Guide for TN.  The only thing I can find so far on it is this:

CANCELLATION OF PURCHASE – BY PURCHASER
FFLs should advise their customers prior to the customer completing the ATF form 4473, that the $10 fee for the TICS/NICS check is due (to the FFL) prior to the check being
run. The purchaser should also be advised that the fee is non-refundable if the customer changes his/her mind once the TICS/NICS check is started. Therefore, a purchaser who cancels his intent to purchase, should not be refunded any fee collected for the TICS/NICS check—that fee is still payable to TBI for the service rendered.

I do not know if that would technically infer that the cost HAS to be $10 and cannot be price-gouged by an FFL or not.

The only thing I can think of is contacting TBI to find out if it's legal to raise the price on that.  Or just buy from someone else, unless the price of the item is too good to pass up on.
