Heres the deal, I am a paramedic at a local ambulance.  On 9/1 I was at work, standing outside performing my morning duties with my partner when out of the blue a MSHP trooper walks up to me.  He says says hey Clint i hear you have a gun.  I'm thinking yeah so what, he asks me if he can see it.  I have to think for a second where is it at?  Oh shit its still in my work bag, which is inside the building.  So I get arrested for unlawful use of a weapon, I spend 24 hrs in jail then have to pay $1000 cash only bond to get out.  I get fired from my job, now I'm unemployed.  Im charged with a Class B Mis.  Spoke with lawyer he said no problem getting me off, because I was about 20 yards away from weapon, when I was arrested and the gun was not readily accessible.

This is where it gets good, apparently I was set up by my employer.  My former Boss called a good friend of mine, i guess he didnt know we were friends and tells him all about it, and tells him that i was threating the cops, had thousands of rounds of ammo in my car and a bunch of other shit.  Then the Trooper that arrested me called him, they are hunting buddies, and starts saying a bunch of shit also none of which is true.  I have had pepole calling me i havent heard from in years asking why i tried shooting a cop!

Anyone think i should sue these fuckers for Defimation? And sorry about spelling and grammar.

You should know where your weapon is at all times bro. As a paramedic, you should have known better than to have a weapon in the hospital/fire station/whatever.  I "forgot" I was doing 85 down the highway the other night, but that didn't mean a damn thing to the cop when I got pulled over/ticketed for doing said speed.

Someone set you up? Who cares? They shouldn't have had the opportunity to do so, YOU gave it to them...

Are you allowed to CCW while on duty as a paramedic?  If not, what was the gun doing in your bag in the first place?

Ignorance of the law does not mean you are immune to it. JMHO.

ETA:  If I am completely wrong about this whole situation, I will appologize.  However, I feel you are leaving something out of the story.

I have a good lawyer I cant put you in contact with, if you are seriously being railroaded.  Also, where did this happen, I have a few range buddies with the MSHP.

It happened in Benton county.  Its crap because almost everyone i work with brings firearms to work and in the building.  If they had searched my partners bag, he would have been arrested also.

I don't see anything illegal about anything based on your post.  What's the part you are leaving out??

Got a news story link or anything?

I gues the building he works in qualifies as one of the above, possibly #17.

Could also be properly posted or in the Employee rules where he works that firearms are not allowed on premises or in vehicles. I know where I worked had a specific clause stating absolutely no firearms on company property... Period...

If you have any money you might consider contacting Kevin Jamison of Kansas City.  He is, IMHO, the best firearms lawyer in the state.  I don't know what he costs but I guarantee this experience will empty your wallet no matter what you do.  Whatever he says, believe him, he literally wrote the book on MO firearms law.

www.kljamisonlaw.com/

I'm sorry that this has happened to you.  Mr. Jamison would also be able to help you determine whether an action for defamation is in order.  On the whole I don't think it would be worth it considering how much money you are likely to be spending in your defense anyway.  Its unlikely that going on the offense against them would be money well spent at this time, but of course that decision is ultimately up to you.

Double check who owns the building. A lot of the ambulance service is privately owned and not a government entity.

However, that is followed by:
" 21. Carrying of a concealed firearm in a location specified in subdivisions (1) to (17) of subsection 20 of this section by any individual who holds concealed carry endorsement issued pursuant to this section   shall not be a criminal act    but may subject the person to denial to the premises or removal from the premises."

Sure, the company can fire you.  But there is no legal grounds to charge you.  So where did the Class B Mis. come from?

Still waiting for more details.  This doesn't make any sense.  You should be able to get a copy of the police report through the prosecutor's office.  What does it say?

I'm a MO LEO and I can tell you that I don't believe this story.  He may have been arrested but I think there was a lot more to this story that what he says.

I got more details today.  The person that called it in made a statement.  in the statement it says he saw the weapon in my car and was scared, although i dont know how he saw it unless he was going through my belongings in my car.  also he states that he heard thru a 3rd party that i had made threats against cops and other ems workers, and that i had brought an AK-47 to work and made threating motions with it.  I dont even have an AK.

The police report just states everything that happened and that he confiscated militia material from my vehicle.  from my vehicle they took a bag of cleaning patches, 2 boxes of .308 ammo, an empty AR mag, several used paper targets(from last range trip), a shotgun news mag, and freds guide to being a rifleman.

This whole thing is a bunch of crap, i keep waiting for my lawyer to call and say that the case has been tossed, but she hasnt yet

Btw, know anyone hiring crazy paramedics that want to shoot cops?

what juristiction in mo were you arrested, and exactly what charges (if any)? Ex- City of St.Louis basically hates guns and has been heard to say they don't honor carry permits.

When I worked for an ambulance service in San Antonio, most of us carried in our dufflebags.  We responded to some nasty areas, and made a conscious decision to take the chance of getting  caught by the po po vs getting caught by some gang member scum with no protection.

If there isn't more to this story (where you're concerned), then this is a bunch of baloney.   When this is sorted out that ass that defamed you needs to be taken to the cleaners.

Well, if it were me, I'd call a lawyer, the NRA, and any public voices I can and make a shitstorm out of it. Ruin a few of these guys if you can.
