Dad gets life sentence for telling son to commit fatal shooting

PHENIX CITY, Ala. (AP) — A judge sentenced a 63-year-old man to life in prison for telling his 11-year-old son to shoot a man.

Charlie Lee Garrett was convicted of murder in June for the killing of Andre Scott, 27, in a mobile home last year. Scott, who was homeless, had been sleeping in the home, which belonged to Garrett's brother.

Garrett's son, Joe Lee Garrett, testified before a Russell County jury that Scott, awakened by the father, took off running when he saw both Garretts held rifles. "Shoot him!" the boy quoted his father as saying.

Evidence presented during the trial also showed that the elder Garrett had been out of jail only 10 days when the shooting occurred. He had served a 30-day sentence for menacing Scott with a firearm during an altercation over alcohol.

In addition to imprisonment, Greene fined Garrett $20,000, ordered him to pay $5,000 restitution for Scott's funeral expenses and to repay the county for court costs, including paying the court-appointed attorney who represented him in his murder trial.

Joe Lee Garrett, now 13, was removed from the Garrett home to the Lee County Youth Development Center. He was not tried as an adult and his Juvenile Court record is confidential.
