GREEN BAY, Wis. -- A prosecutor says a sexual assault complaint against Steven Avery involving a teenage girl in 2004 won't be prosecuted now -- but could be later if Avery isn't convicted in the rape and murder of Teresa Halbach.
Brown County District Attorney John Zakowski said the complainant doesn't want the case to go forward right now, because Avery could end up behind bars for life if convicted in the Halbach case.
"I think it would be a very embarrassing trial for her and it's gonna have more of an effect on her than Steven Avery," Zakowski said. "It's why I think this is the most logical and appropriate action to take at this time."
Zakowski was asked to evaluate the sexual assault allegation made in Manitowoc County in August 2004, months before Avery was accused of Halbach's murder.
No details of that victim's allegations have been released.
In November, Avery was charged in Manitowoc County with first-degree intentional homicide, mutilating a corpse and possessing a firearm by a felon in the Halloween murder of Halbach. She was a photographer who had gone to Avery's home near Mishicot take a picture of a vehicle he was selling.
Last month new charges -- first-degree sexual assault, kidnapping and false imprisonment of Halbach -- were filed against Avery after his 16-year-old nephew Brendan Dassey said he helped his uncle commit the crimes.
