I just had a meeting with a branch manager and field service manager and supposedly I was looking up porn at work.  She is going to look into it to see if there really is a password or not, but she'll probably be able to get past it.  I never tried so I don't know.  Or even care at this point.  I'm already starting to look for another job.  This pisses me the fuck off.  I am not stupid enough to look up porn at work, on the clients system, and especially not on their damn machine.  I have my own porn, and I have a high speed connection at home.  Why would I do something that can so easily get me fired?  Especially since she asked me if I knew about the history.  If I know that there is a record, why the hell would I still do it there? And she obviously didn't believe me.
If I am going to be fired at least let it be for simething I actually did.
I feel like I'm living a bad country song.  First I come home from the Middle East to find my wife on drugs, then I find out I have a rare form of cancer, and now I'm almost certain to be fired for something I didn't even freaking do! WTF over?!?
At least it's not too hard getting a job as a security guard, too bad they almost all pay less than I'm  making, was making.  But fuck it. I can work two jobs, maybe three if needed to keep up with my bills. And hopefully get ahead so I can go to school, and finally get a real job. I think I'll quit even if she determines it wasn't me.  This pisses me off so damn much.

Anybody know of anyplace that's hiring?  Prior active, current National Guard, currently a security guard with a tiny amount of sales experience? I'm already going to hit all the gun and knife stores in th area, as well as the other security companies.
I do have some computer knowledge and skills, mostly just Word.  Don't know Access or Excel yet though.  And no I don't have porn skills.

That sucks, does your company have an HR department. I would start there first and maybe retain the services of a lawyer. It just depends on how much you want to fight it.

What area?

I was looking into getting a security gig at the local casino/card house in Renton. You could always try there and other casinos. I'd imagine they all have a high turnover rate. I think a lot of the job is sitting and watching security cameras. Are you state certified?

I thought about that.  The thing is I don't know if there is anyway to prove that it wasn't me.  I'm not sure how they have the time pinpointed down to between 0100 and 0600 on a Monday morning.
Can polygraphs be used in civil court?  At this point I am so disgusted with this company I don't want to work for them.

I didn't think about the casinos.  I do have the state unarmed guard license.  If/when I lose my job I'll have to turn it in to the company, but the state does have a method of transferring them. Thanks for the idea.

Sounds like your getting the shaft, but hang in there, if you quit, you will get no unemployment money, if they fire you, you MAY get your unemployment. They(the company) will have to deny your claim and give reasons that you can dispute, of the last 5 guys that have been fired at my employer(all for valid reasons) 4 have got there unemployment after denial/dispute proccess.

My motto when dealing with employers like this is " I was looking for a job when I found this one" Best of luck to you.

Crimony yea - hold out for the unemployment.  Last guy that got fired at my place was because we has "daylighting" as a real estate agent during his "breaks" (which could last 1, 2 or 3 hours!).  When he was finally ratted out, we denied his claim stating he was fired because he was working a second job while he was supposed to be doing ours.  The state said that was ok - real estate agenting isn't a real job (huh?)    So basically, you can get unemployment for having two jobs but still be considered unemployed .

They still might have a patrol route that runs in Tacoma.  Pay is a little low.  $10 pr hr I think.

The time the sites were accessed will be  in the computer, tell them you want a print out of exactly what sites and the exact times for your attorney. even if you don't have one they don't need to know that.

If it's a winblows pre xp machine, even if they have accts set up you can access and use the machine without a password.

If you're former/current military, why not look into getting on with state patrol or local LE, I bet the pay much better than Peckerton rent a cops.

I am not a fan of lawsuits, but being fired for something you did not do is NOT a good thing, especially if you don't fight it.

How many places are going to want to hire you if your former employer states you were fired for porn?  I would guess your company will give you the option of just leaving without making a fuss.  Flat out tell them no, and tell them that you will not be punished for something that you did not do.  

See what they are using as an excuse.  Let the people who are furnishing this information know that it is false, and that you are going after THEM BY NAME, as well as the company in your lawsuit.  Let them know they are making it very personal.

I'm hoping that this manager will get the information soon from the client.  Best of all (for me anyway) would be if they got the days mixed up. I'm guessing it's later then Win98, at least I hope so since then there isn't anyway to just click cancel on the password screen, whether a login screen or the screensaver.  I think then she'll just say that I plugged my laptop into their system.  Well I hope that she would say something like that, since I also know that then the MAC and IP addresses from my machine itself would be logged and if they don't match it would be hard to still say it was me.  My roomate is a network admin type guy too and has told me a few things to look for.
It's not even coming firsthand from the person making the claim.  The client is telling it to the manager,and just gave a time frame that it happened during.  What makes it harder for me is that I was the only one on the property during that time frame.  If there is a log of sites being visited at that time I have no way to prove otherwise. Malware dialing out maybe?
I don't plan on quitting until I am already employed.  I may be a bit petty about this, and am still bitter, but it would be nice to have a new job in hand, and for them to admit they were wrong.  At that point I would still quit.  Just her attitude was enough. I did put in for the assistant manager position at Quantico Arms. Maybe I'll get lucky there. Tomorrow, I'll be hitting a lot of places, starting with Worksource for an app packet for the company that's has the gate contract at Ft. Lewis.  A night shift there would be perfect for me.  I am still hoping to find a way to go to school (I still want to be a nurse.) during the day.
I swear, if I had a dog to run away, my recent life would be the perfect old time sad country song.  It's at least a blues song.

First you need to decide if, considering your health condition, if you want to deal with this stress at all.

If no, I still would not just walk away.

Find a employment rights attorney.  Not hard to do, use the yellow pages.

If it were me, and I'm not pretending to know you or know every bit of this situation, I'd get the lawyer.  Move on the angle that "if porn was accessed on my terminal I didn't do it/someone else accessed the terminal when I was not there."

Then I'd work on getting the heck away from this company because the target will be on your chest from now on.

I would then negotiate my departure under better terms.  The minimum acceptable terms would be a letter of recomendation to my next employer and a written promise of nothing of this episode being divulged to third parties.  

And you could always fantasize about a months pay on the way out of the door.  /fantasy.

Well...since I do this kind of stuff for a living.

Ask for a forensic image of the HDD for your own discovery and tell them they can talk to your lawyer.  

There are numberous forensic toolkit discs you can download and burn that are bootable so you can review the data yourself.  Very easy to nail this stuff down.

Dumb question, but what is PSSP?  It sounds familiar, but I can't place it.

I can't use that angle since, at the time they claim I did it, I was the only one there, behind a locked fence.  Unless somebody was hiding in the building (AFAIK from what I was told, we don't patrol the interior, just the outside) and accessed it when I did my outside patrol.  That seems unlikely, and so the only thing I can think of is either they have the times or date wrong, or some sort of malware/spyware is linking to pages on it's own.  Too bad this wasn't one of those locations where even the lobby is covered by cameras.  They'd have me on record reading a book or watching Black Hawk Down and the Princess Bride (allowed according to the field manager), but no porn surfing.

I am willing to go pretty far with this just to clear my name, and of course my own stubborn, and somewhat petty and vindictive nature.
That's why I hope that this place is using a newer OS that is totally locked out with the password, and that she then claims I plugged my laptop into their network.  Just so I could offer to have my roomate who happens to be a network admin type (MCSE and all that, worked at the MS data center, is in the IT dept. of Madigan now) take a look. Because I know that there would be a server log of the MAC address of whatever machine is hooked up and when.  Unless of course she wants to claim that I have a second laptop that I take just so I can access porn at work or something stupid.

Unicorn, I think Big ern is precisely right on all points. If you have cancer, your employer provides benfits and they know about your cancer (document it) you need to lawyer up yesterday. Only place Big ern and I disagree is the one month pay, your lawyers the only one that can give you advice of course but I'm thinkin' a months pay is a nice token, but insurance until you find employement that you like (free, for indefinite period) and legal costs would be the goal for me.

Also, as an IT guy I don't grok how someone could "pinpoint" an access to a -five- -hour- period. They either know the minute and second that the browser popped that html or ... not.  Either way I'd leave and I'd work to do it on my terms. All of this is my opinion only, if I were a lawyer you'd already have my bill ; )

Oh, and reading your last post here... if they have a network that offers up valid IP addresses to any surfer off the street they have bigger security issues to consider. Yet another reason to work elsewhere. (and dont let them trick you into disclosing your mac address) (never mind, just get a lawyer). all imo

My employer doesn't give me any benefits.  I also am not paying for health care through them since it sucks ass.

My cancer (actually the treatments are over and I'm just doing the follow up appointments) was treated by the Army, and the follow ups are being done and will be doen through either the VA (if I can get through their confusion about which hospital I go to, should be Madigan as it handles the patients with odd SSN's, but they keep trying to send me to Seattle) or the Tri-Care Reserve Select, an experimental Tri-Care that the Army is currently allowing NG and Reserve soldiers who have deployed buy.  Up to one year for every 90 days they were deployed.  Just so I can still see my same doctors.

Basically here is the situation.  I worked at a location a couple weeks ago.  I brought in my laptop to watch movies.
A couple days ago I was called in.  They asked me if there was anyone else in the building.  I said no, they asked me if I was sure. I said that there was nobody else I saw until I opened the gate at 0500.
They told me that someone was downloading porn sometime between 0100 and 0300, and it was recorded in the history.  She made a big deal about if I knew that there is a history, then asked if I wanted to change my statement.  Of course I said no. Then I mentioned the fact that when I've moved the mouse on the desk, (to get it out of my way) the screensaver went off and it asked for a password.  She then told me that I "know" that all you have to do is hit ok and it will get past that, and that all you need the PW for is changing files.  Maybe on Win98.  I don't know what the OS on this system is though. Didn't need to know, didn't care. I sort of pointed out that on newer OS's that isn't always true.  She then told me she'd have to go back out there and see for herself.
And that is where it stands right now.
Oh, she did ask me if I had plugged my laptop into their network and I hadn't.
I mean damn, I know that it leaves a record.  I've had to get someone fired for doing that at my last site.  How the hell would I do something so damn dumb, KNOWING it leaves a massive trail???

Talked to both managers yesterday.  The client was "uanble or unwilling to provide proof," of their claims.  Well duh! There wasn't any. Still looking for a replacement, but with less desperation and now can try to find something that pays the same or better.  Also going to try for a steady schedule with under a different manager if possible.
