First read makes me think this goes a long way to making "shall issue" the rule and not the exception.

It's a good start, but the significance for now seems to be limited.  Basically just a panel telling the district court to reconsider the dismissal in light of the court's findings.  Same judge wrote the opinion as in Peruta.  Peruta, of course, got overturned en banc.  We'll see how it goes, but the timing seems good such that if it gets far enough that it gets overturned en banc (as it likely will be if it goes far enough), then an appeal to SCOTUS will be after Kavanaugh is on the court.
