Yes i was planing on getting the gsg 5 with the colapable stock (the one that slides in) and i was wondering would it then be considered a SBR with that stock on it because it will become smaller that 16" when it is in?

The collapsible ones are fine, the BT folder puts it under the mandatory 26" overall length. The 16" refers to barrel length.
So, for a rifle to be legal ( without a lot of paperwork ) it has to have a barrel 16" long or more and an overall length of 26" or more.
Just to make things interesting some states have different rules
