Characteristics

This upper receiver alters the method of feed from magazine-only to belt-only and the caliber from .223 to 8mm Mauser. The dimensions of the lower receiver are not altered in any way. It simply clips on just like the standard AR-15 / M16 upper receiver. Its design is based on the MG-34 and it utilizes some parts from the MG-34. The XMG-99 upper receiver operation is "blow-back" only rather than the original "gas/blow-back" operation of the AR-15 / M16. Unlike a MG34, the XMG-99 is a closed-bolt system that relies on the AR-15/M16 fire control system. It is capable of semi-auto fire only operation with AR-15 and variant weapons and selective fire with M16 and variant weapons. Original MG34 selective fire components and bolt cannot be introduced to XMG-99 configuration. The system is normally fed from 50-round flexible, metal belts, two or more of which can be joined end to end.

The XMG-99 CANNOT be mounted on original MG34 ground tripods but has been adapted to mount onto MG42 ground tripods. It can be mounted on MG34 antiaircraft tripods but not MG42 antiaircraft tripods. The XMG-99 comes equipped with an original MG34 bipod.

I received an email from BRP Guns a couple weeks ago about this upper. It is now in production and should be available in mid December. It is considered a title 1 firearm and will sell on the standard 4473 yellow form. Yes, I want one and plan on getting one for myself.

ummm.. don't you need the ffl for the lower? why wouldn't the upper be sold as a part just llike the ferret 50 or any other ar upper?

You can only use new production ammo in it.
That means at least $0.40 a round.

I think I read somewhere that the upper CAN be made to fire without being attached to the lower. Thus the need for the FFL.

I forget just how it can be done, though. Just that there are enough parts present to fire the thing.

You can fire a standard AR-15 upper assemly without being attached to a lower, all you need to have is a frame that clips to the lower with the trigger groups, a tube attached to the back of the upper (or modify the bolt carrier to blowback or something) and you got a upper that can shoot.

I believe the ATF requirement is that portion that holds and feeds the ammunition and/or magazine, is the part that is considered the firearm.  Cylinders on revlovers are considered just that, magazines.

Here, because that upper feeds the ammunition, it also is considered a fire arm.  If the lower is complete with out any alterations I would wonder if you need 2 4473s.
