so my father-in-law busts out and old Ithica Auto and burgler 20gauge double barrel pistol!

It came from his dad after he passed away 10 years ago!!!



He HAS NO IDEA ABOUT NFA STUFF!!

So I mentioned it to him and we need to get him legit. Where do I start? is it similar to an SBR paper setup? Is he in for trouble for waiting for so long? It was originaly registered as an NFA item by his father....

A Form 5 won't work in this case. From the OP, it appears that the gun has never been registered. Therefore, it would be contraband and subject to confiscation.

+1 Unless you know without a doubt that it is already registered, I doubt that it is and therefore can't be made legit.

No it was registered as an NFA Item by his father! So it is on the registry already, it's just that the original owner is dead, and the son now has it. Looks like a form 5 is the way to go!

And the ATF states that it must be done in a timely manner, I'm thinking they are not going to be willing to agree to 10 years as a timely manner.

I can attest to this happening but that was also some time ago and, as Tony said, who's to say what ATF may do given this particular situation.

I bought a Auto Burglar from a gentleman near my home that was amnesty registered in the 30's. He inherited it and never transferred it into his name. I simply filled out the F4 and transferred it to me, I also included a death certificate of the father who was looooong dead. They never said a word and approved it in less than a month.
