it was originally purchased in the early 80's by a police officer who has passed away and his brother wound up with the rifle so he says and wants to get rid of it legally

If there hasn't been a large amount of time, it's possible it coudl be legally transferred. But if it's been sitting in a closet for years, i don't know. I'd talk to a lawyer that's well versed in NFA and firearm law. There's always a possibility. If you call ATF direct, they'll probably want it surrendered. If you're lucky they won't try to prosecute. Your odds are far better with a lawyer. |

Possession of an NFA firearm not registered to the possessor is a violation of Federal law and the firearm is subject to seizure and forfeiture. However, we do allow the executor a reasonable time to arrange for the transfer of the registered firearms in a decedent's estate. This generally should be done before probate is closed. In past cases, ATF has allowed the legal transfer of estate NFA items as long as eight or nine years after the death of the registered owner, as long as in the meantime they remained in the possession of the executor of the estate. But this is done on a case-by-case basis, and getting an attorney involved increases the chances of success if it's more than a year or two after he died. Without legal representation, ATF is more prone to just saying "it's now contraband" and confiscating it. Since factory Colt M16s are $10k+, it's worth paying a lawyer to make sure you don't lose it. |
