There were two big developments Monday in the case of a motorist who was shot and killed along Greenwell Springs Road Friday after a fight with a police officer. Investigators say an autopsy shows the deadly bullet was fired by a bystander, not the officer. Police also announced that no charges would be filed in the case, either against the police officer involved or the bystander who fired the fatal shot into the head of George Temple.

East Baton Rouge Sheriff's spokesman Greg Phares says Officer Brian Harrision was escorting a funeral procession Friday when he pulled Temple over and wrote him a ticket for breaking into the procession. According to Phares, that's when Temple attacked Harrison. Police say Perry Stevens was walking outside of the Auto Zone on Greenwell Springs Road when he heard Harrison yelling for help. Harrison was reportedly on his back with Temple on top of him. That's when Stevens went to his car and grabbed his .45 caliber pistol.

According to Col. Greg Phares, "[Mr. Stevens] orders Mr. Temple to stop and get off the officer. The verbal commands are ignored and Mr. Stevens fires four shots, all of which struck Mr. Temple."

Perry Stevens fired four shots into Temple's torso. Officer Harrison had already fired one shot into Temple's abdomen. With Temple still struggling with the officer, Perry continued to advance toward the scuffle.

"He again orders Mr. Temple to stop what he was doing and get off the officer. Those commands are ignored and he fires a fifth shot and that hits his head. The incident is over with, and as you know, Mr. Temple is dead."

Police are calling the shooting death justified. Perry Stevens has a permit to carry a concealed weapon. Col. Phares would not give out any more details relating to the shooting. Both Phares and Baton Rouge Police Chief Jeff LeDuff stopped short of crediting Stevens with saving the officer's life. LeDuff says the entire incident is unfortunate.

"I spoke with his father at the scene briefly," said LeDuff. "I think this is a tragic situation all around."

9 News is told George Temple has a criminal record, and Officer Harrison was involved in a shooting while employed as a prison guard in East Baton Rouge Parish, where he was suspended for three days back in 1995.

good.  one less ass-bag on the street.   Pretty sure one of the C's in CCW  means "carry",  I think the whole "went back to his car to get the pistol"  part could look bad in court if it was a matter of lawsuit.  This, as opposed to a "i drew my weapon from my holster and fired to save the officers life"  any one else see this?   Don't get me wrong, i am on the outstanding citizens side.

I suspect that cop will be very pro-RKBA for private citizens in the future if he is not already.

must've been a hella big dude on some strong drugs to take 4 shots from a .45 ... wow. i wonder how much the ticket was to piss the guy off that much.  i'll def never even think about cutting into a procession haha. (not that i would before......)

Don't forget the officer got one round into him during the struggle too!

I think this only re-enforces the fact that a pistol is not howitzer and shot placement is crucial.

Reading between the lines, I don't think it was a simple matter of he just cut into the procession. There must have been something else that caught the officers attention to the point of stopping him to issue a ticket…

What happened was, not only did he cut into a funeral procession, but he was also driving dangerously; speeding, weaving in traffic etc.  That was what caused him to get pulled over.

The standard duty calibers are 9mm and .40 S&W which are less effective than the .45 with stopping power. We have the Cali incident where some SOB was ventilated with round after round of 10mm and kept comming. Are you glad you don't carry 10mm too?

Some people through adrenaline and other factors are machines. The rest boils down to luck and placement in that order.

I wish there were pictures of the dead guy hung and tied up by his ankles and the cop and good guy standing on either side of him shaking hands in the middle.  You know, Kinda like taking a picture with a shark?

Good for the good guy here, I just hope he realizes he did a good thing and not listen to the tree-hugging-anti-gunning liberals when they start beating their drum.  I am glad he helped the officer.

The National Association of Assinine Colored People filed a frivolous lawsuit? The hell you say. I wonder how they would comport themselves if some jackass sued them because black people are statistically proven to commit more violent crimes than any other race in the US. I HATE people who use color, choices, religion, and lifestyles as a crutch!!

The naacp isn't doing what it was intended to do in it's origion.  I do not believe it, in any manner, reflects on decent black people.  It more reflects the stereotypical low lifes and bottom feeders who want a government handout.  I believe the naacp is a socially acceptable, modern day HATE organization.  I grew up with the only black students in our school living with me for about 5 years, and they hate the naacp and are embarassed by the things they try to pull.

I also work, hangout, lift weights, hunt, family too, and friends with a lot of black guys/gals.  I must be in a vaccum, but they all hate the naacp too....... What is ironic?  Most of my black friends don't like blacks? No clowin fool

naacp isn't what it used to be, do some history and you'll find that white people help start it up.

Believe me I have fought countless times defending myself as well as my 2 black foster brothers here in rural Oklahoma do to racist comments and threats directed toward me and my family, so by George I can speek my mind about how I think these naacp punks think.

I get called racist about 80% times during arrests of blacks, and my black partners get called Uncle Tom, just cause we are doing our job. I call them a racist right back to their face and tell them keep using that crutch buddy, keep using that crutch........  Maybe my black partners need to contact the naacp cause they are being racially slurred being called Uncle Tom!?!? There's and idea.

Good Lord any hoody black sob that wants to break the law (as long as the cop is WHITE or UNCLE TOM) the naacp will be there to defend his punk self.

So if you are black and are offended by my post, screw you racist punk.  If you are black and agree, well, let's go fishing cause we will get along.

I'm with you WW.  15+1 and 2 spare mags just in case.  I hope I can do better if the need arises, but if it takes all of them and they all hit the target somewhere, then I'm a happy camper even if it was #46 that finally stopped the a-hole.

Good citizen and good job Mr. Stevens.

And they totally ignore the fact that the hoods you are busting are the same ones who prey on THEM night after night!
In 80-90% of all violent crimes, the crimes are commited within racial boundaries: black vs. black, white vs. white, etc.

Wow.  I watched that video too.  Did I hear it wrong, or is some legislator looking to rewrite what is acceptable as far as a good shoot as a result of this incident?  I'd like to think coming to the aid of an officer falls into that category.  Maybe I just heard it wrong.

The standard duty calibers are 9mm and .40 S&W which are less effective than the .45 with stopping power.there is no such thing as stopping power, when a 9mm which is a 35 caliber round opens to a avg of a 50cal and the 40 opens up to a 60cal and a 45 will open to a 70cal, there is more damage done with a larger round but what stops someone is a hit to the spine or brain, bleeding out takes awhile. The 45 is more leathal but as far as stopping someone instantly is only accomplished with a round, anyround hitting the right spot and a 35cal round expanding to a 50cal is more than plenty to bleed someone out or hit the right spot to drop someone, and most of all you need to know where to shoot to instantly stop
