is it legal in NY to  put a us made mag follwer in as a us part count. being that hi cap mags are only legal if manufactored before 1994. is it considered manufactoing or upgrading?

I am not an attorney, but I would consider that replacement parts.  During the AWB, there were plenty of people upgrading USGI Mags with no-tilt followers and new springs.  If NY law is the same, then you should be GTG.  Just don't let any of your friends insert their mags in your gun!
