I will be going deer hunting for the 1st time this season, and instead of bringing the same old 30'06, or AR15, I would like to be different. Is it legal to hunt with this? Pretty sure it is an 8mm round. Thanks.

Find some Mauser softpoints & you should be good to go. IIRC, I bought my green box of soft points at Wal-Mart.

Hell yeah.  If you're comfortable with it and can shoot accurately, it should be a great deer gun.  I can't imagine how in the world it could be illegal for hunting anywhere (except in shotgun-only areas), but YMMV.

BIG +1 on soft points.  Never use ball ammo -- always go with something that will reliably expand.  I'd go with some premium hunting ammo, personally.  I took 2 deer one day with .30-06 ball.  It ended out OK, but it was a stupid mistake.
