For DUI. He was a .18% driving the wrong way on a one way with two passed out marines in the car with him.
Only thing keeping me from feeling like a total hard ass is it's his second one, he was just convicted of DUI in June '05. Plus he was on his way to a married womans house who happens to be a meth addict. So he's not exactly Marine of the Quarter material. |

You did the right thing, and before all the DUI-enforcement-haters jump in, yes, he could have killed someone if you hadn't stopped him. That, and his second in 6 months? He obviously missed that lesson.

Nice strawman. He was going the wrong way and blew a .18. The posts you see here complaining about DUI laws are about random searches (aka roadblocks), every lowering BAC limits, arrests when someone wasn't driving (like a guy sleeping in his car or the girl that was pushing her car), and stops for petty reasons like a tire touching a center line or not wearing a seatbelt. I've never seen anyone here defend this type of behavior. Can he end-up in a military prison for this? That would really be harsh, but appropriate.z |

No, I have not seen those posts in the years I have been here. The scenarios YOU describe are "what ifs" always put forward by the DWI apologists. Good arrest BTW: Saved a lot of work by the coroner. |

Most likely to get the Big Chicken Dinner. (BCD Bad Conduct Discharge) I saw men discharged for civilian DUI's and .mil confinement for on base DUI's but never saw one go to the brig for an offbase DUI's. DUI is a career wrecker though, as it should be. Late 70's Early 80's the Moped was the Staff NCO transport of choice due to the onbase privilges being revoked. About 1985 after the drug problems had been solved by the Whizz Quiz the .mil went after the drunks. The Services are better for it. You did the right thing IMHO. Every friday formation beat it into our head "Designate or take a Taxi to the clubs". My buddy Max was a nondrinker and always drove. Guys paid for his goodtimes at the stripjoints 5 nights a week. |

Stupid is as stupid does- two arrest in less than six months and someone needs to be doing time. I couldn't care less that he's in the military, I've had to pick up the pieces after too many DUIs to have any sympathy for him.

Glad they are defending us in Iraq, but many of them think that gives them free rein over our streets and cities. Some of them need a reality check and hopefully his second arrest will, but probably not.

If you ever feel bad about hooking up militaty guys, dont. I normaly try to give the benifit of the doubt to service members, hey I was one. But, being military is not a get out of jail free card. Just ask them " if I was an MP, and this was on base, what do you think would happen?" MPs arent cutting anyone slack on base . BTW speeding is not DUI, there is no tolerance for DUI.

Summer of '04 I had an 18 yr old reservist doing 85 in a 55. His unit had been activated and stationed three states away. He was home on leave and "forgot" when he actually had to be back to work. He was already one day late for reporting back and was not going to be there in time that day either. Anyway, he still had too much alcohol in his system. He was tasken in for being over .02% but under OWI limit. So he just received a speed and a license revocation from the state.
After finishing the paperwork, he called his mom, while I went into the other room. I didn't know this but at our front desk was an Recruiter Sgt. doing a background check on a new recruit. What luck. I asked him if he new this kid. He said he knew him well. He is at XXXXX Army base. I told him he was actually in our booking room. He asked to see him and I showed him the way. The kid on the phone looked up and saw him and turned white as if he saw a ghost. He couldn't even speak to his mom anymore. After a long ass chewing by the Sgt., a few phone calls, and lots of tears, they were on their way back. Kinda felt sorry for him, but he made his own bed. That had to be a long ride back. |

I'm a Marine and a cop. Fuck him. There is SO much training in the Marine Corps about substance abuse there is no possible way that he didn't know it wasn't ok.

Being a former Marine, everyone always assumes Marines are saints, when I served '72 to '76 there were a lotta guys that had a choice between jail or enlisting, units were so shorthanded from UA's that one time we went on a movement with guys from the brig, a bus would pull up and there cuffs would be removed and you talk about some tough Marines. Drugs among the junior enlisted and alcoholism among the senior enlisted were more than isolated incidents. To sum up some of the best people I have ever met were Marines and likewise some of the worst people I have ever met were Marines. In any organization you have good people and you have bad people, maybe the best thing for this individual's drinking problem was an intervention, removal of driving privileges even jail time can wake you back to reality.

Work in a college town and have a lot of brave young men and women in Guard units who have returned form a tour in Iraq. The times when I have had to take enforcement action they were fine. Made sure to tell them thanks for their service.
Had one group of drunks in the downtown looking for fights one night. They told one of our Officers that they thought the military should be imposing martial law here. Explained that one of the first things they would do was to "kick the ****out of the local cops to get control". I know they were just drunk but what a group of asses. |

In Arizona, if you're DUI on a suspended license for DUI, he'd be looking at a Class 4 Felony and 4 months DOC time. Mandatory minimum.
I feel for the guy, I have two Marines in my family, but he should've learned his leason the first time. |

Guys flashing MilID ontraffic stops / contacts get the same rash of shit that an LEO gets from me when he flashes a badge. Don't give me something I didn't ask for, don't assume that you'll be treated diferently than a normal schmuck would.
That being said, good collar, did the Marines a favor. My Father-in-Law was a Marine and had low tolerance for Marine F-ups. |

it is a shame though, but equal in its own right. men and woman fight for our country, in that is said, MEN and WOMAN , military is composed of men and woman, not boys and girls, regardless what the mothers of america says, if you mess up, take it like a man, thats what my old CO use to preach to us before and after a major 96 hour block. when i was in the corps (like 4 months ago) i got back from iraq and felt a great deal of "invincebility" b/c ,, well hell, i survived 8 months of shitheads trying to kill me in a hellhole country, what could possibly go wrong at home. alot of military members feel that way when they arrive home. to the young pvts' pfc's and lcpls the saftery standowns and the briefs are a bunch of BS and they get tired of them and dont listen.... the ones that dont listen... you see in the blotter the next couple of days b/c they wrapped there brand new 05' stang around a pole for doing stupid shit..... Marines are saints,,, but also jarheads... a jar filled with a void, and empty space... we are fricking morons... and the lower half of us are the ones that do this stupid shit and give the Marines and the military a bad name. after getting out... all them breifs and saftey standowns make alot more sense now! ironic

+1 Many of us make mistakes...I have made mine What it came down to is an out of control alcohol problem. I am not saying this is a disease, it was a string of bad decisions clouded by alcohol. I deserved mine...he deserved his. I don't expect sympathy for DUI'ers but...however, jail rarely solves anything...usually it only complicates the problem. Some people learn the hard way...hopefully this will be hard enough for him, and he learns before he kills someone. |

My homestate lets you drive on an expired DL as long as you are active duty, stationed out of state, and present the the Military ID with the expired DL. Don't assume that every military guy is trying to infuence you with the military ID. He may actually belive he has to present both. |

BIGTIME +1 My DL expired 18 month after I enlisted. I kept the same one for all 11 years of active duty. Ohio law required me to present the ID card with the EXPIRED Drivers Liscence. |

You did the correct thing for several reasons. You may have saved his and other lives and sometimes we all have to take a hit sometimes to realize we may be on the wrong path. After this he may have a different outlook on how he wants to live his life and what is important. You have obviously made him look at life in a new light, you damn sure probably made him reevaluate his future choices and how he wants to live his life. You may well have changed his life and kept him from making even more stupid and poor decisions in the future. I bet you are allot like me and know there are some thing that we as LEO's can do that will make the appearance go much better, I am sure you know what I am talking about

Good job. 2nd DWI in six months shows that he is definitately a danger and certainly doesn't get it!
I just had to sit a client down and tell him that he is going to jail for around 3 years and going to lose his $100k/year job b/c he just got his 3rd DWI (2nd was 6 mo ago with his kid inthe car). He was on probation for teh felony child endangerment that he got with his 2nd DWI - so even if we beat #3 in front of a jury- they would revoke his probation. The multiple DWIs are the worst. |

I'm a cop and a Marine as well.That Devil Dog should have learned the first time.What if god borbid he had killed someone while DUI?If he wants to go out and drink then fine, just have a designated driver plan.Here in Nevada state law says a DUI suspect must be taken to jail.No exceptions.

2nd huh? Should have learned the first time. When I was in the military our chain of command made it reallllllllll clear that if you f-up you will have serious consequences to face, DUI was a major one they talked about. Later

I did cut him a couple breaks. I didnt impound his car for driving on a suspended and i didnt tell the DRO about his prior so he would get cited out the next day rather than held two days till arraignment.

A drunk marine crashed in the the back of a CHP officer in Oceanside a few years ago killing him. I have gratitude and respect for the good marines. As with all drunks, drunk marines need to go to jail.

I'm a sailor who owes his life to USMC but that's a 2X drunk. I sure hope he learns his lesson and you can't quit trying to teach him. Good bust sir.
BTW: Y'all have to have a LOT of latitude and I'll also squawk loud (right here on ARFCOM) if I think poor judgment was applied by an LEO. |

2nd in 6 months, that would be a felony here in Oklahoma. He should of drank more and passed out at the crank whore's house.
Good job brother, don't let it bother you. If they are DUI, I give them ZERO tolerance, the only breaks I have given people is "Public Intox" them instead of DUI, but that is few and far in between but they still go to jail and are off the street. |

Not to sound like a hard-ass, but I write military personell DUI's allot. I work next to an AFB and these guys have no regard for public safety. I don't want to hear how I don't understand, because I was in the army in combat arms for years. Military members should know better and must be held to the same standard as cicilians. My .02

There is no excuse for driving around drunk. This goes double if you are in the Marine Corps, as noone in the Marine Corps goes more than a week without getting or giving a "Don't drink and drive and if you're gonna tap it wrap it" lecture. I have used the just got back from Iraq card once. The day I got back from Iraq my SNCOIC loaned me a car until I could retrieve mine from Georgia. I was driving back to Pendleton from Temecula when I looked up and spotted the blue lights. Then I noticed that I was doing about 120mph, and that I was in deep shit because, unlike Iraq, California has speed limits. The officer was quite understanding, and let me off with a warning to slow down. |

I was a First Sergeant in the Army in the early '90's...when I first took over my company I spoke with the NCO's and troopers separately (due to a place to get them all together in a good atmosphere)... I asked the Troopers if they knew that smoking dope (the major drug problem then) was illegal and against Army regs...they answered "Yes"...I asked them if they knew that if they came up hot on a piss test that there was nothing I could do for them, they answered, "Yes", so I asked them if they understood that if they got popped for dope that they should know that I would recommend "the fucking MAX" to the Commander...the fellas said they understood that too...
Same went for the NCO's...the military has made no secret of its policies for drugs and DWI's...I imagine not much has changed since I retired in '93...every Friday at formation came the "Threat Brief", Don't drink and drive", Don't smoke dope" and "If you're not signed for it keep your hands off it"... The military teaches you to be responsible and if you choose to ignor that advice, well, you're a dumb ass...everyone knows someone who has gotten popped for DWI or dope... Good job... |

Ironically I spoke to another Marine from the same unit last night and he said his company CO has a designated driver program. Any Marine with a car can vounteer to take a car load of marines bar hopping on a friday or saturday night and act as the DD. in exchange the DD gets an extra day of liberty on a friday or monday, as operation schedula permits.
Shit! A free 72 hour weekend for staying sober one weekend night is a hell of a deal! |
