the amendment modifies the definition of
a "large capacity ammunition magazine" by inserting the word "permanently" in
between "been" and "altered."

 The State recognizes that some of its representatives may have provided
informal advice to the effect that an ammunition magazine may be temporarily
blocked to hold no more than 15 rounds; however, the Attorney General has never
expressly adopted this position. To the contrary, through the promulgation of
this regulation, the State expressly rejects that interpretation of the
statute. Any person who currently owns or possesses an ammunition magazine
which has been temporarily blocked from holding more than 15 rounds is hereby
advised that he or she may retain possession of that ammunition magazine until
the effective date of this amendment, that is, the date the notice of its
adoption by the Division of State Police is published by the Office of
Administrative Law in the New Jersey Register, see N.J.A.C. 1:30-6.6. During
this time period, a person who owns or possesses an ammunition magazine which
has been temporarily blocked from holding more than 15 rounds shall either: (1)
transfer such ammunition magazine to any person or firm lawfully entitled to
own or possess a large capacity ammunition magazine; (2) render such ammunition
magazine permanently incapable of holding more than 15 rounds; or (3)
voluntarily surrender the ammunition magazine pursuant to the provisions of  
N.J.S.A. 2C:39-12. After the effective date of this amendment, a person who
owns or possesses an ammunition magazine which has been temporarily blocked
from holding more than 15 rounds shall voluntarily surrender the ammunition
magazine pursuant to the provisions of N.J.S.A. 2C:39-12 or risk prosecution
for unlawful possession of a large capacity magazine pursuant to N.J.S.A.
2C:39-3(j). Finally, N.J.A.C. 13:54-1.2 has been amended to include a
definition of "pistol grip" and "semi-automatic." These definitions are
identical to those contained in N.J.S.A. 2C:39-1(z) and (x), respectively.
Specifically, "pistol grip" has been defined to mean a well-defined handle,
similar to that found on a handgun, that protrudes conspicuously beneath the
action of the weapon, and which permits the shotgun to be held and fired with
one hand, and "semi-automatic" has been defined to mean a firearm which fires a
single projectile for each single pull of the trigger and is self-reloading or
automatically chambers a round, cartridge or bullet.

And since (as far as I know) there are no 15 round AR magazines out there, you guys are going to be stuck with 10 rounders (that don’t work)!!

I’d find out ASAP what an acceptable permanent conversion of a 20 or 30 round magazine would entail.  The immediate response will probably be “we don’t know, but that’s no excuse for you not doing it”.  

And, of course, you’ll probably have to convert them to 14 round magazines since, if they’re 15 round mags and someone can force an extra round into it, you’ll go to jail.

I’m not a lawyer, but it seems to me that the state might be bound by it’s “informal advise” which resulted in you guys buying high cap mags in “good faith”.  On the other hand, ATF sometimes reverses itself and gets away with it.

How can the government make something you possess illegal, when it was formally legal, then charge you with a crime?  Isn't that getting real close to ex post facto?

I would think at the minimum, they'd either have to compensate you for the mag if you surrender it, or pay for the modifications to make it legal, especially when they are admitting to giving out false information!

This is outrageous!  I hate NJ, I live there part time and hate this garbage.  Does any one think that writing the outgoing Col. Carson Dunbar will make any worthwhile changes? Or would that put my Reg. on the dash of every NJSP cruiser?

Who at the NRA do we contact to get this thing stopped?  What do i pay my dues for!

I don't get it when exactly does this take effect I think soon it will come to some drastic measures.Just look at all those gov high officals involved in ENRON.Now we have MR BEAN as GOV we are in deep trouble.

It says the old law expires on May 17, 2002. It also says to submit comments (inter-departmental?) by March 8. Somewhere between those two dates I would imagine it has to be voted on by the state legislature.

Not much time for you guys to call your representatives and bitch. Get busy.

This isn't even a law.  It's a "rule" invented by the police to tell us peons what the laws really say.  The NJSP doesn't enforce the laws, they write rules and enforce those.

I called the area NRA lobbyist's office and emailed him the page.  His sec. said he was aware of the rule change and was working hard to get things changed.  I  have yet to  hear back from him.  His name was Greg Costa, and i was told to direct emails to [email][email protected][/email] and in the subject line put Attn. Greg Costa.

Got a return email from the  NRA,  text below:

Thank you for contacting NRA-ILA. As for your concern over a proposed
revision to the New Jersey firearms code that would restrict magazine
capacity, please know that we are aware of this proposed change and are
working with the new administration to see that this suggestion from the
outgoing administration is disregarded.  We will be sure to keep our

Hey Fellow NJ GUYS, this is only the beginning. Look for our current GOV. to push for a handgun ban!. This guy is Florio2, maybe one step worse. Got inside info that he is pissed about NJ gun owners supporting Schundler. He will try to push for the first handgun ban by private citizens in the US. Think it can't happen? That's what I thought about the first National  Rifle ban without a Grandfather clause!!Well it happened here!!
