Yes, you could buy one without paperwork. Not recommended though. The BATF could see it as "constructive possession" of an NFA firearm.
File the Form 1 for the SBR registration and get the SBR upper once you get the approved Form 1 back. |

It is fairly safe to have a short *barrel*, but having that barrel installed on an upper receiver (which could be installed on your lower in a few seconds) would certainly be seen as "intent" if you didn't already have a regsitered SBR. A plain barrel would require tools and time to install, and would be less likely to get you in trouble if discovered.
