So, about 5 years ago, some dirtbag stole my mail. With the information they gathered, they opened up 2 cell phone accounts (I live in the dark ages with no use or desire for a cell phone, LOL) and also stole some "convenience" checks from my credit card company totaling about $10K on those checks(even after I told the CC company to stop sending that crap to my home.....they claimed it woud take 90 days to stop it).
So, I filed a police report and they deemed this "identity theft/fraud". I also filed a report with FTC about the identity theft. Long story short, all parties involved agreed I had nothing to do with the fraudulent charges. I got all 3 of the credit reporting agencies to send me a copy of my credit and they placed (I believe) a 6 month hold on issuing any new credit under my name. My credit is VERY good now (as it was before this incident). I have never bought a rifle or pistol. This was to be my first.....all of my other rifles and pistols have been given to me by my father. So I go down to pick it up, fill out the paperwork and when they call to verify.....I get denied b/c there is a "question of identity" on file with them. So, I now have to send them a copy of my driver's license, my Social Security Card, the Police report, the letters from the cell phone company/ credit card company showing I'm not responsible and probably a semen sample. Has anyone else had to deal with this type of situation? What's the fastest way to resolve this? Is faxing the information better than emailing and is emailing or fax better than snail mailing? Any ideas on how long it will take to clear this complete non-sense up? I'm thinking fax will be best/quickest, but should I wait until Tuesday morning (to get past the holiday weekend)? The gun dealer told me (contrary to the pamphlet with all the information on how to dispute a denial) that I didn't really HAVE to get a fingerprint stamp done by local LE agency.....Is this true? I just want this cleared up ASAP and don't know how to go about it. Any help is GREATLY appreciated. Thanks in advance, Sean |

This may be the case.
When I was working at the gun shop, I never got information on why someone was denied or delayed - that is between you and the FBI. Send in the paperwork according to the instructions. I have had a few people who have been denied every time, wait 3 days or they send in something, come back and get a call from NICS to proceed. It's normal for them and they go through it every time. Get a CCW and you'll bypass the NICS call in requirement. Good luck. ETA: I worked in AZ at the time, last year. Where is the shop you went to? |

The first year NICS began , a LOT of "Infrequent" gun buyers got delayed or denied .
The people doing the checking made mistakes or were over diligent Nowadays , the System is about as efficient as govt. employees can make it Once you provide full ID proof you will probably NEVER have a problem again. Funny story - I have bought MANY firearms in the last year or so , and EVERY time they ran the check , the dealer read off my 1st , middle , and last name. EXCEPT two weeks ago (dealer forgot to read MIDDLE NAME ) When the checker came back on the phone and ASKED for my middle name , the Dealer looked at me like I had TWO HEADS |

It was at Bear Mountain Sports in Mesa. Glad to hear this isn't that uncommon. I was really ticked....one, it's embarrassing b/c the gun store owner might think I'm some sort of criminal and 2, it's as if I'm guilty until I prove I'm innocent.....which isn't the way my vision of America is supposed to work (IMO, of course).
So, can I expect that once I provide copies of my DL, SSN, etc. that it'll only be a few days before I'm allowed to purchase? What's even stupider is that I have a DoD security level clearance at work. Thanks for the help. Sean |

I had a Chandler PD cop get denied one time. He was pissed. I told him to go turn in his gun - he wasn't supposed to have one according to the FBI. He laughed about it after that. Came back the next day and all was okay.

DingDingDingDingDing!!!!!! If you have a higher level then the guy doing your check you will get a delay until somebody higher up can do your check. Or at least that was the reason I was given anyway... |

I have never been denied (yet), but I get delays more often than not. Having a carry permit seems to make no difference, as I get delays just as frequently after getting it.
Not long after the NICS started, a former coworker was denied. He was pissed, then got really pissed when he found out the reason for the denial - a juvenile arrest that never went to court. |

+1 I was never denied but it always took a long time to complete the check process. One time it was 48 hours. I got tired of that and got my ccw and there is no problem now. |

In PA, the CCW don't mean shit when it comes to a purchase. Before the "Instant Check", all you needed was a CCW to walk out with gun in hand (no three day waiting). Now, they don't even want to see it.

So, has anyone specifically been in my situation where there's a "question of identity"? Did you HAVE to send in your fingerprints to get this resolved?
The more I think about this, the more ticked off I get......I'm not a criminal, but I'm being treated like one. I will likely have to go down and get fingerprinted and have to PAY for it (to add insult to injury). This is BULLSHIT. It's unfortunate that the ACLU will only take on cases that favor their socialist agenda, b/c my 2nd amendment rights are clearly being violated. Sean |

I also get delayed %95 of the time! It really miffs me off! I have not so much as a speeding ticket to my name! Longest I had to wait was about 45 mins. at a gunshow. Usally after the primary call they refer me to another check and wait.... my FFL dealer gives them the refering # and told to proceed. Your deal seems much worse.

Someone with your name may possibly have some questionable offenses on his record. Thats what a local FFL of mine has told me anyways. Supposedly when you send in your SS card and all that good stuff it will get cleared up.
I have never been delayed. One time it took 5 whole minutes to get approved for a handgun! lol |

In AZ a state CCW exempts the NICS call in requirement. You won't have to have it called in and wait. Thye just put the CCW info on the 4473 and you're off. No muss, no fuss. Bonus: You get to carry your firearm concealed with you. It also means less hassle with cops on a traffic stop - usually, not all the time. I wouldn't worry about papering a gun so much. Too many guns to track and trace. Not enough manpower to chase it down unless it's a crime gun. Even then, they can't always track them all the way through. It would be like going door to door and collecting pennies from the homes. Insurmountable. Not a job I'd want. You might get this problem whenever you get a firearm on a 4473 if they call them in. You might be stuck having to send in print cards and verifying your ID every time. A CCW would nullify this requirement. It's up to you, but you might want to consider this option. |

Lots of AZ ARs in EE all the time. Several ARs in the Arizona Repugnant every week. Lots of gun shows. Just scoot through the "gun show loop hole" and you're golden.
Remember, a loop hole originally was a hole to shoot through. |

I dont want to take this too far off topic but oh well--you guys out there in AZ have some wicked trails. Are you going to compete with that buggy? Out here in PA, I have Neuroc in my back yard, those rigs in the compititions are sick. I stick with the ez'r stuff in my heep (I drive it every day). Now back on topic. |

The difference with CCW is that you only go through it once, and they get your prints as well as an FBI check, include all your evidence in your package and you should never have to go through it again, even with CCW renewal in AZ. When you buy another firearm on yellow paper, the shop bypasses the NICS, they fill in a part for your CCW permit and you're off to the races. In your situation, this sounds like the best option or you might be facing this everytime you buy a firearm through a dealer. You might even still find this issue if you go out of state or a dealer does a NICS call in on you. Good luck. ETA: Check out the trails at Butcher Jones and if you feel real lucky, Crown King. I played around Butcher for years. I did the Crown King trail a couple of times. Nice looking rig. |

I really hate that it's come to this over some asshole that wanted a free cell phone. You should get your AZ CCW. Your other option is to file a FBI Voluntary Appeal File which should clear up your identity problem for future NICS checks. This is different then the denial appeal you already filed.
www.fbi.gov/hq/cjisd/nics/vafbrocheng.pdf You should also make sure that there are no open arrest warrants under your name, DOB and SSN. I would not delay doing this as you may find yourself under arrest if you're ever stopped for a traffic violation. |

For any of you wondering why you have to continually be denied/delayed.....the above link explains it and I would/will be continually denied unless I submit the above form AND fingerprints. Nothing better than being treated like a damn criminal to exercise your 2nd Amendment rights. :rolleyes: This is complete and utter horseshit. SeanK1ng, you might not have any open warrants that you know about. The problem is when someone assumes your identity and they commit a crime using your name you may end up with an arrest warrant in your name. Verify that you have no open warrants and keep copies of your identity theft reports/investigation with you.

So how do I go about finding out if I have any warrants against my name? Can any PD run that check or will it only turn up things in that municipality?

If an arrest warrant was issued it will be entered into the FBI NCIC system. Every PD in the U.S. has access to it. Call or go down to you local PD with all your paperwork and ask the desk officer if they can run a wants/warrant check on you. Better to find out that way then to be cuffed/stuffed into a cruiser at the side of the road.
You might want to let a local attorney know what you're doing beforehand in the unlikely event you need one. |

Did a 4473 for an AR on 6-1 ish - OK on the spot Did a 4473 for a bolt gun on 6-15 ish - delay < 1 day ... big whoop Got printed by DHS for some other stuff on 7-12 Got follow up papers from DHS re prints on 7-12 sent on 7-14 stating clear to proceed Tried a 4473 for an AK on 7-15 - NICS said I was an ILLEGAL ALIEN Started appeal that day with Email, they sent letter. I sent more Emails, VERY PROMPT AND COURTEOUS replies (ended up sending letter to supervisor to thank and commend). FAXED copies of other DHS forms. Got an Email that basically said "Oooops. We messed up" Got my rather corny looking official document that said it was OK to sell me a gun a month later Here is the kicker. Because more than 30 days had passed since the original NICS check, we had to do a new 4473 and new NICS - and it was DELAYED! This is whey I came unglued ..... NICS called back in 5 minutes (I was still ranting and raving, abusing office furniture), PROCEED |

I have experienced NICS delays, so I sent all of my info including fingerprints to the FBI asking for a copy of my RAP sheet. Even with all of my info, I experienced a delay on my next gun purchase. If something is on your record, including something that may have never gone to court, then you need to get it removed from your record to prevent delays. If it is a result of mistaken identity, then I don't know how to help you. The only way that you'll know, is to send in the request to the FBI for your record. |

Well, it is indeed a case of mistaken identity. I haven't found out the particulars yet.....was only able to call today. They should be mailing me the specifics this week. Apparently, some asshole (perhaps the guy that stole my mail) got busted and either had my information on his person or actually gave my information as his own, so my real name became this guy's alias. B/c of that, they need my fingerprints to compare to the guy's that they arrested and printed. If they don't match, then I should be approved.
This is still complete and utter horse shit. I don't see how this can possibly be legal. The FBI is stopping me from exercising my Constitutionally protected 2nd Amendment rights, considering me to be guilty as an identity theif until I prove myself to be innocent. Their "policy" of getting fingerprints to prove my identity supercedes my Constitutional right and has ZERO basis in law, so how in the fuck is this legal? Policy cannot dictate law. I've never been fingerprinted so the best way for them to ensure that I am who I say I am is to ask for additional forms of ID. Afterall, the gun dealer isn't going to have a way to check my fingerprints when I come in to purchase a rifle.......this is just moronic. Sean |

As is the entire concept of gun control laws. The government creates laws to prevent criminals (who, by definition, don't obey laws) from legally obtaining guns, and the end result is that non-criminals are the only ones restricted by the law. |

Well you can do what they want and get it cleared up or keep bitching and waste time.
BTW if you have a clearance, other than just a standard Secret on a NAC, it can flag your file, and if they are still doing a background to finish it off, your file may be sitting on somebodies desk. Or it might be waiting in the to be refiled pile. And if you have an identity theft issue, cry yer eyes out, but learn to live with it. It will haunt you for a while. Now last time I checked the FBI didn't steal; your identity but if it makes you feel better to blame them, go ahead. The fact that you know have a verified theft issue and the various powers that be can back that up, you shouldn't have too many credit issues now AFTER you show that you were a victim. So bitch about the people that screwed you, not the ones that didn't. |

It didn't give me any specifics (as promised in the NICS brochure) about why I've been denied other than someone with my name and their fingerprints apparently either committed some vague felony or possilby a misdemeanor with a sentence of more than 2 years. After over a month without my $900 or the rifle b/c of the Feds' fucked up and completely inefficient system, I guess I'm supposed to be happy and tell them "Thanks" for breaking it off in me and taking my Second Amendment rights? So why am I still “bitching” since my case should be cleared up shortly? B/c the system could be improved to better serve the citizen. Why did I go ahead and contact my state Senators and the NRA after I went ahead and sent in my fingerprints? B/c I’m trying to make this system better for EVERYONE who should legally be able to purchase a firearm. A lot of ARCOMers will open this post and see the original poster telling people to fuck-off. Dude, don't do it, especially since you started the thread in the first place. People that can help or share their similar experience will see this shit and say FUCK IT. On ARFCOM you need to be prepared to just let shit go. There's lots of opinions base on minimal information because generally that all we have to work with. This site is WAAAAY different than any other I've been on if people think that I started this....I can take care of myself, but if that's not allowed here, I'll abide by the rules. I appreciate your response and advice, but I said what I said and I stand by it with regards to the manner in which I addressed PaDanby (or whatever his name is). I'm the EXACT same in real life as I am on the net. Many keyboard cowboys have questioned that until they've met me in person. Basically, I've garnered all the information on this topic that I need to get my situation cleared up and this will probably just degrade into a name-calling thread. Is there a way to just delete it? SeanK1ng, If you haven't already done so you should also request your criminal history file from the FBI. In addition to clearing your record up at the Federal level you will also have to clear it up in every state where an arrest under your name has been made. This FOIA request is different from the NICS denial appeal process.
I don't blame you for being pissed off because this is going to be a royal pain in the ass for you. If arrests have been made in multiple states you need to put your anger ( justifiable) aside and persist in clearing your name in every state. Because of privacy issues for certain types of records you may run into some roadblocks but you need to follow up on every one of them.
