Is it legal to put a .223 upper on a lower receiver marked as 7.62X39?  The receiver is a legal preban and the new upper would be a preban configuration.  I just want to make sure this isn't assembling a new assault rifle because of the caliber change.  Thanks for the help.

Yes. You can also convert it to 9mm. You can even do that to a post ban provided you don't add naughty features. Caliber has nothing to do with pre/post status.

With a preban lower marked 7.62x39 you can change it to a .223 with all the naughty features.
