Try reading "The Embarrassing Second Amendment". I believe it was written by Stanley Levenson. He goes into detail on the US vs Miller case in 1939 as well as other cases. In that case, the justices indicated that it was ok to ban sawed shotguns because they were not of common use by the military. Conversely, those weapons used by the military were protected by the Second Amendment.

The case is U.S. v. Miller (1939). I don't have the reporter cite handy.
The article is by Sanford Levinson. Eugene Volokh is a another one, and Williams VanAlstyne (who is one of the foremost 1st Amd experts) makes mention of it too in a couple articles. |
