A pre-'81 drop in auto sear is for sale on gunbroker.com. The seller states that no FFL is required. Previous posts on DIAS were adamant that it is HIGHLY ILLEGAL if papers are not with it. Which is it? Is he selling an illegal machinegun on gunbroker?

Not legal to own if you own an AR-15, and probably not legal even if you don't and don't have an FFL.  Those pre-82 DIAS have no serial numbers and no way to prove they were manufactured before 1982.  Therefore the burden of proof would be on you if the ATF decided to pursue it.

Stay away from them.

Pre-81 DIASes are DIASes made prior to 1981. IN 1981, ATF decided that DIASes were conversion devices and therefore were MGs. Instead of amnestying them as they should have, they grandfathered them.

The ones made prior to 1981 are legal to own and don't require an FFL as they are not firearms. The ones made after 1981 are MGs and require not only an FFL, but the proper paperwork (Form 4). The main issue is that there is no way of proving that a DIAS was made before 1981. In fact, many may have been illegaly made post-81 and put into the flow. ATF's testing is never conclusive as to date of manufacture. So, you buy at your own risk. If you possess a Pre-81 DIAS and an AR15, you have a MG. If you have a post-81 DIAS, you have a MG even lacking the AR15.

The only reason I can see that anyone would buy a DIAS would be that they expect either the ATF to finally get called on not properly amnestying NFA weapons including the DIAS and Open-Bolt MACs in 1981 and Street Sweepers in 2000 which were registered, but not on the Amnesty Form as should have been done.

If the ATF were to eventually be called on their actions in 1981, there could be an amnesty. That means that the DIAS could be registered legally. But, I don't believe that the possibility is large enough to risk a daily ass-raping by Bubba.

If they do have an amnesty, I will break out the drill press and drill a proper sear hole, not hold onto a DIAS on the far-off hope....
