OK..

Say a magazine was made here during 1980 and was sent to another country over seas. It has a capacity of over 10 rounds and is obviously preban (being made in 1980). To this day, it remains overseas.

Would it be legal to bring that "high capacity" magazine back to the United States and still keep it's legal, preban status?

Anybody know of any loop holes, or documentation on where it says I can, or cannot do this?

All help appreciated!

Do you really think that all of the mags that importers are bringing in are really "pre-ban"?  That's why Sweinstein is so intent on "closing the import loophole" and banning the importing of ALL hi-cap mags, pre-ban or not.

As far as an individual importing mags, you'd need an import license (mags are treated VERY differently when crossing international borders) and probably an FFL to be approved by Customs, BATF, and possibly even the State Department.  Importing mags is only financially feasable when importing large volumes.  Importing a dozen mags would almost certainly cost far more than buying existing pre-ban mags, due to permits, fees, and paperwork.  Importing 10,000 mags is something else.

Does this hold true for mags that are not for resale, but for personal use only?  Please advise.

So is it legal to leave the US to a country that allowes 10+rounds,and if so why wouldnt you be able to bring back the mags that you took? I know of people who traveled to other countries and when they did so they got permission from that countries embassy or customs(not sure which) on paper to bring a firearm. So what if you went there and came back, you couldnt bring your mags back? how would they know exactly what mag you are brining back, they dont have S/N.

M4,

You're getting into an area of discussion concerning illegal acts.  You want to bring back the 10+ mags you left the country with?  You'd better register them and the firearms you take with you with US Customs before you leave the country.  If you don't, you likely won't be allowed to bring those vary same guns and mags back into the country, much less bring extra ones back, too.

It's illegal to import post-9/13/94 10+ magazines into this country.  Period.

exactly how would you register a 30round AK or AR magazine with customs? Im not sure its possible. Also when you fly they dont search the baggage you check that goes under the plane,so if you were going on a hunting trip to africa and you put a few of your accessories in your checked luggage, and you registerd your guns with customs how would they know what acc. you took/came back with?

M4,

Smuggling guns and magazines into the US is a felony.  Talking about how to commit a felony is a violation of Forum Conduct Guidelines.

CG,

It would cost you far more to import a few "pre-ban" high-caps than it would to buy ones already here.  Good luck getting an import license.

Pre-ban mags are still being imported.  The importer has to get a certificate from a government agency in that country or the exporter, or some or certifications, saying that the mags were made before a certain date.  In a lot of these countries it isn’t very hard to get a government official to sign of on bogus pre-ban mags.

One example I’ve seen recently is the Bulgarian Waffle mags for AK-47’s.  These mags were never seen anywhere on the world market that I am aware of.  Odds are they are very recent manufacture and a bogus certificate was obtained in Bulgaria, making them “legal” for importation and sell here in the States.

It is still illegal unless, as stated above, you have an import license and have jumped through all the hoops with the ATF & Customs.

Let me get this straight,

If the mag is documented as being manufactured prior to the ban, and

If you have the appropriate paperwork, then

It may be imported legally???

I don't care about cost, lisc and all the other BS.
Is it legal under the above scenerio?

Having an opinoin on a Hypothetical situation is against site policy? thats like saying NOBODY on this site could talk about the next possible terrorist targets the DOD issues on homeline defense and then we all couldnt respond how how we feel about how well the Goverment protects us. I was simply stating that when I worked at BWI airport for two years and searched,x-rayed and did chemical testing on checked luggage it was NOT 100% full proof. I still dont see how that would be against site policy.I apologize for my statements if it is.
