Routine traffic stop reveals stolen assault weapon Submachine gun, ammunition and high-powered binoculars found in vehicle

A traffic stop by city police officers on Route 301 near Pointer Ridge Drive July 21 ended with an arrest and the recovery of a gun.

Officers performing the traffic stop observed marijuana in the vehicle. A subsequent search of the vehicle, incidental to arrest, revealed a Luger Tec-9 style submachine gun with a loaded magazine of 21 hollow point rounds.

Also recovered from the vehicle, was a box of 9 mm hollow point ammunition and a pair of high-powered binoculars.

A computer check of the serial number on the gun revealed that it was reported stolen from North Carolina.

The driver of the vehicle, Norman Leroy Davis, 35, of the 2300 block of Glenmont Circle, Silver Spring, was arrested and charged with possession of a concealed deadly weapon, possession of an assault weapon, possession of a firearm by a convicted felon (Davis has a conviction in Montgomery County for possession with intent to distribute PCP), possession of a stolen firearm and possession of marijuana.

Maryland court records show that in addition to the PCP conviction in Rockville, Davis has three prior drug convictions and a prior weapons conviction, all dating back to 1997 through 2003.

Davis was interviewed by detectives then processed and presented before a district court commissioner. The commissioner set a bond amount of $25,000 which Davis posted the same day and was released.

Well, since they've decided it was a "Luger", somehow I find myself doubting that it was indeed an SMG.  Someone googled "TEC-9" after seeing a police report, is my guess.

No, they only ones banned are the ones specifically listed by name in MD law.









after June 1, 1994, a person may not;



(1) Transport an assault pistol into the State; or



(2) Possess, sell, offer to sell, transfer, purchase, or receive an
assault pistol in the State, EXCEPT; A person who lawfully possessed an
assault pistol before June 1, 1994 may continue to possess the assault
pistol if the person registered the assault pistol with the Secretary
of the State Police before August 1, 1994.



An assault pistol is defined as any of the following specified firearms
or their copies regardless of which company produced and manufactured
the firearm:



AA Arms AP-9 semi-automatics



Bushmaster semi-automatic pistol;



Claridge HI-TEC, semi-automatic pistol;



D Max Industries semi-automatic pistol;



Encom MK-IV, MP-9, MP-45 semi-automatic pistols;



Heckler and Koch semi-automatic pistol SP-89;



Holmes MP-83 semi-automatic pistol;



Ingram MAC 10/11 semi-automatic pistol and any variation including the Partisan Avenger and the SWD Cobray;



Intratec TEC-9/DC-9 in any centerfire variation;



P.A.W.S. type semi-automatic pistol;



Skorpion semi-automatic pistol;



Spectre double action semi-automatic pistol (Sile, F.I.E., Mitchell);



UZI semi-automatic pistol;



Weaver Arms semi-automatic Nighthawk pistol; and



Wilkinson semi-automatic "Linda" pistol.



Some of those are pretty hard to find. Tec-22 rimfires are legal. any carbine or sbr version would be legal (sbr with stamp). Interestingly enough, even though the skorpion is listed as banned, the state roster board just approved the vz61 skorpion for sale last november, which means they are legal to purchase even though they are also banned.

On second thought this will probably end up as a "deal of the day" on Cam & Co. when this guy gets off light (AAAAGAIN) and goes out and rapes or kills a single mom, conveince store clerk or police officer.

There was a US-made POS 'gangsta gun' called the 'Skorpion' (forgot who it was made by, but I think it was the same folks who did the TEC and AB weapons), which was NOT related to the commie gun of similar name....





Most likely, that is what they were talking about in the ban....

The police report probably had it listed as a 9mm Luger TEC-9. The author probably didn't know that the Luger was part of the caliber and not the manufacturer of the weapon.

With the criminal history, misdameanors and the felony, and that nice long list of felonies he just got, they only set it at $25000, which is $2500 at the bondsman? If the guy had that much shit in his car, his "my baby ain't dun nuffin" momma probably bailed him out with the money he's been stackin at her house....

Unless it was manufactured prior to 1/1/85, in which case the roster doesn't apply.

I'm surprised they did not also nail him for transportation of a pistol, but that might be under the concealed deadly weapon charge.  You're only allowed to drive them between your house and your FFL, hunting activity, gun range, or business you own.
