Technically if you say no they can't proceed without reasonable cause, but I believe if they had reasonable cause they wouldn't ask you in the first place

To answer your question the best thing to do is not get stopped. If you have already been stopped I would decline just as respectfully and nicely as possible. Asking to search is just being courteous. If your a smart ass or rude your vehicle WILL be searched. A k-9 will be called and the k-9 will hit on your vehicle, that is if it ever had dope in it or it ever had any cash in it.Thats the probable cause. Now there are some sites out there advocating locking your door, rolling up your window, calling a friend, and parking near the road lines in an attempt to endanger some officers lives. I never heard of one of these being successful, since you just blew any chance of getting a warning for whatever it was you got pulled over for. That means its now moved to the citation/arrest level. Not really where you want to go.
Politeness is always a plus. I have learned in my many years on this earth that there are certain people you do not want to piss off. Cops, doctors, judges, serial killers, ex wives, illegal alien making your taco, girl that has your privates near her mouth, car mechanic if you don't know shit about cars, etc. Just my humble opinion. |

The problem with "no" is they often word the question, "Do you mind if I search your vehicle." "No" "ok thank you"

usually i'd say "i'd rather you didn't".
but once I did say "sure why the hell not, i got nothing illegal, my pistol is the glove box, my rifle and machete and first aid kit and a blanket and tools and spare water and shits in the trunk, theres no way you can hurt any of it just by lookin so knock yerself out, on the condition that i get to sit in yer car while you do it" He said nevermind after that. |

Happened to me in 1990/1991.
Pulled over in Maine for speeding during the early morning hours. No question that I was speeding. During the initial interview I was asked by the trooper why my eyes were bloodshot and I explained that I was a night shift worker (mil), hadn't gotten any decent sleep the past few days and was on a 72hr break and on my way to a friend's house to sleep. I was further asked if I had drugs or weapons in the car and I answered that I did not. He asked for consent to search and my answer was, "No, sir." He asked again and explained if I had nothing to hide, I should let him search. I declined once again. He threatened to bring a dope dog out they will find anything that I was hiding. I asked, "If I don't consent to search, you will bring a drug dog to search instead?" "Yes." "Ok, bring the dog." He asked me to step out of my car, I grabbed my smokes (he searched the box to make sure I didn't have any weed in there. I sat my ass on the armco and waited. Waited for almost 30 minutes for the K9 handler to show up. I question the "reasonable" amount of time from initial interview and finally having fido the drug sniffing K9 to actually arrive. The dog nniffed around my car, didn't alert on anything, I got a ticket while the trooper wasted plenty of my time that I could have spent sleeping. |
