Can I put a pre-ban upper on a post ban lower, if I have the bayo lug cut off and take off the flash suppressor. Also that leaves me with the threaded barrel. Can I have a BATF approve post ban compensator screwed on to the threads if it is pinned and welded after it's screwed on? This has really been bugging me and I would appriciate your help.

Yup to everything you said.  Go see Kurt at the Kurt's Kustom forum.  He did one for me and it turned out great.

If the lug is removed and the brake is permanently attached it's perfectly legal.

It would seem to me that the cost to do this would be much greater than selling the upper on the equipment exchange and buying a post ban upper. IMHO of course

well if u got the upper super cheap ie in a tapco m16 kit it could be worth it

According to ATF regulation 921a. the muzzle brake must be either welded or silver soldered to at least 1,100 degrees or more. the weld must be at least half the circumference of the muzzle or four spot welds around the circumference of the muzzle.

the bayonet lug must be "chopped" off. you'll then have to deal with refinishing the area of the lug.
