Ohio Supreme Court rules Brunner must allow early-voting observers

Ohio Secretary of State Jennifer Brunner must order counties to allow observers at sites where early absentee voting is taking place, the Ohio Supreme Court ruled today in a 4-3 opinion.

Brunner, a Democrat, had advised county boards of elections not to allow observers where in-person absentee ballots were being cast.

She argued that although the law specifies when observers are allowed, such as at the polls on Election Day or when absentee ballots are being counted, it doesn't specifically allow observers for in-person absentee voting.

But former Republican Franklin County Commissioner Dewey Stokes sued after he was denied access as an observer, arguing that state law allows observers at polling places whether it's on Election Day or for early voting.

Observers from both parties and issue committees are allowed at the polls on election day if they file the proper paperwork, but they are not allowed to challenge voters.

Ruling for the majority opinion were Republican Justices Paul E. Pfeifer, Terrence O'Donnell, Robert R. Cupp and Judge Lynn Charles Slaby of the 9th District Court of Appeals, a Republican hearing the case by assignment.

Dissenting were Republican Chief Justice Thomas J. Moyer, Republican Justice Judith Ann Lanzinger and Judge William Herman Wolff Jr. of the 2nd District Court of Appeals, a Democrat also sitting by assignment.

Republican Justices Maureen O'Connor and Evelyn Lundberg Stratton, who are on the ballot this fall for re-election, removed themselves from the case.

Yeah, I seen her on local news tonight, she tried to blame all of the attention Ohio is getting over the registration hoopla on the Republicans trying to cause a distraction.

Of all the ACORN nonsense she accuses the Republicans for the mess.
