"Ashley McIntosh was killed in a violent collision with a Fairfax County police officer who ran a red light at a high speed with no siren on February 12, 2008. The officer was charged with reckless driving and went to trial. The court found that the officer's actions were not reckless and delivered a not guilty verdict." |

odd that i dont remember seeing this on the news or anything when it happend
That's Fucked up all those car out on a rain day and this dumbass doesn't think it is necessary to use lights and siren and .gov say that ok..................great training |
How can that not be the very definition of "reckless"?
That's impossible. |
hate to say it, but the jury was right. ETA: and the law needs to be changed. |
Trial by Jury or Judge only?
I can't see how any jury would not find that completely negligent. |
What do you bet he declined a jury trial and let the judge decide. A jury would have likely found him guilty. A judge was more likely to interpret law and policy in his favor.
I hate to judge without knowing all the facts but...
that officer was running with no siren, in the rain, and ran a light. Pretty damning to me. I couldn't tell, but did he slow down at the light? With the long line of people in the turning lane, he would have had very little or no way to see oncoming traffic from the left. |
Anyone have a link to other info?
If his camera was on, wouldn't his lights be on? Even if, It looks reckless to me. |
End of story |
did above, hit " enter " one line too soon. Basically, the law says it's the cops discretion. He chose poorly, but it was still a legal poor choice. |

Well the lights were on, they were turned on when he entered the prior intersection, there is an "L" icon that comes on. He's also on the brakes from the prior intersection, almost up to the crash. That's kinda the problem. It's his responsibilty to "clear" the intersections he is approaching. |

A few months ago a cop here was running 75 in a 35 and killed a guy leaving work. He goes on trial for manslaughter next month.

www.fairfaxcounty.gov/police/news-releases/2008/021308crash.htm so it seems the lights where on, but you can't see through cars like you can hear, and it was a female cop |
And some folks wonder where the PR problem cops have comes from. It might the legal for him to drive like that, but most of the common folks don't agree.

WOW only a cop for 1 year and 22... |

What is a call for service? |

define:Manslaughter 1 Unlawful killing without intent to kill. It can be voluntary (such as a deadly fist fight) or involuntary (such as an accident caused by a speeding car). 2 An act of killing a human being unlawfully but not willfully (as opposed to murder) 3 Manslaughter is a legal term for the killing of a human in a manner considered by law as less culpable than murder. 4 is the killing of a human being, but without the type of intent required for murder and so on So icy roads middle of day lots of car, then when do you turn siren on ?

Why was the cop going so fast? |

Don't know the rules out there. Here the cop broke the rules and he and his employer would be held liable.

It would seem. What a crock of shit. -X |

Responding to an alarm at a business which turned out to be a false alarm. |

No settlement for next of kin, right? |

Yep, but this still holds true. _________________________________ |

In Florida, even with lights on, emergency vehicles must slow at a red light to ensure green side traffic has stopped and sees the vehicle. We did a hypothetical case on this last semester. It's a darn shame all the way around. If the training was what has been implied, then the verdict was correct. Wrong, but correct.

KArma will catch up hopefull y hell be eaten alive and concious by fireants.
No siren, obstructed view for any vehicles approaching from the left, and through a red light no less. |
It was a she. Not that it changes anything. |
Basically, a call for service is the generic name for any reactive issue the police deal with. When someone calls and asks for the cops it is a "call for service" |
Whether it was false or not is irrelevant. It wasn't a life or death call. Does Kentucky have the same discretionary use of lights and siren rules like VA? |
And the cop gets off without even a slap on the rist, whats new.
With guys like that out there whos life is really on the line every day? |

The civil suit is next..... |

Stupid bitch cop. I hope she burns for all eternity for being a stupid cunt.

Officer at fault for not clearing the intersection. Should have been convicted.
ETA: Ah, I why no conviction under their law. However, I still fault the officers actions for not clearing the intersection. |

Virginia Officer Not Guilty in Fatal Crash
Posted: Friday, September 19, 2008 Updated: September 19th, 2008 10:30 AM EDT Most Read Most E-mailed E-mail Article Print Article Story by nbc4.com FAIRFAX, Va. -- A Fairfax County police officer charged with reckless driving in connection with a fatal crash was found not guilty Thursday. Officer Amanda Perry was responding to a shoplifting call on Feb. 12 when her cruiser struck a Toyota sedan driven by Ashley McIntosh, 33. McIntosh was pulling onto Route 1 near Boswell Drive, police said. The McIntosh family said the rookie officer was traveling at speeds close to 50 mph without running her siren when she ran a red light and crashed into McIntosh's car, ejecting her from the vehicle. Three witnesses testified that Perry sped through the intersection without sirens running. A key piece of evidence that helped exonerate Perry was video from her dashboard camera. "The judge saw the video and heard all the testimony and the judge found that that did not rise to the level of a conscious disregard for life, limb or property," said defense attorney Ed Nuttall. According to Virginia law, officers are not required to run their sirens when they drive through red lights. McIntosh was engaged and worked as a teacher's aide at Clairmont Elementary School in Alexandria, her family said. Her family was disappointed in the verdict and disappointed that Perry has not apologized. http://www.officer.com/web/online/Top-News-Stories/Virginia-Officer-Not-Guilty-in-Fatal-Crash/1$43308 Bench trial.
