"Ashley McIntosh was killed in a violent collision with a Fairfax County police officer who ran a red light at a high speed with no siren on February 12, 2008.

The officer was charged with reckless driving and went to trial.

The court found that the officer's actions were not reckless and delivered a not guilty verdict."

How could this happen? Because Virginia law says an officer's speed and use of lights and siren when driving through a red light are determined by what is "reasonably necessary." In otherwords, at the discretion of the officer. .

That's Fucked up
all those car out on a rain day and this dumbass doesn't think it is necessary to use lights and siren and .gov say that ok..................great training

Trial by Jury or Judge only?

I can't see how any jury would not find that completely negligent.

What do you bet he declined a jury trial and let the judge decide.  A jury would have likely found him guilty.  A judge was more likely to interpret law and policy in his favor.

I hate to judge without knowing all the facts but...

that officer was running with no siren, in the rain, and ran a light.  Pretty damning to me.

I couldn't tell, but did he slow down at the light?  With the long line of people in the turning lane, he would have had very little or no way to see oncoming traffic from the left.

Well the lights were on, they were turned on when he entered the prior intersection, there is an "L" icon that comes on.

He's also on the brakes from the prior intersection, almost up to the crash.

That's kinda the problem. It's his responsibilty to "clear" the intersections he is approaching.

Officer Involved Crash in Mount Vernon Area
A police officer was involved in a two-car crash at approximately 5 p.m., February 12 at the intersection of Richmond Highway and Boswell Drive. A 33-year-old Alexandria-area woman driving a Toyota sedan pulled onto Route 1 and was struck by a police Ford Crown Victoria, headed northbound on Route 1. The officer was responding to a call for service and had activated the cruiser’s emergency lights. The Alexandria-area woman suffered life-threatening injuries and was transported to Inova Fairfax Hospital. The officer was treated for her injuries and released.

Crash Reconstruction Unit detectives are in the early stages of their investigation into determining the factors of the crash. The officer is 22 years old and has been with the department for one year.

The officer was responding to a call involving a shoplifter and a fight, Gotthardt said.

He did say that Perry was responding to a report of two men beating another man, which turned out to be two men capturing a suspected shoplifter.

Officers were investigating whether the icy conditions played a role in the crash

www.washingtonpost.com/wp-dyn/content/article/2008/02/14/AR2008021403704.html

McIntosh was thrown from her car and died the next day. She was a kindergarten teacher's assistant at Clermont Elementary School, a job she had always wanted, and was engaged to be married this summer, her family said

The misdemeanor charge against Perry did not please either side. McIntosh's family had hoped for a more serious charge, such as manslaughter. The Fairfax police union, and Perry, had hoped for no charge. ....................................................
Morrogh said yesterday that Perry's actions constituted a "momentary lapse of judgment" that did not rise to the level of manslaughter but did warrant a charge of reckless driving.

define:Manslaughter

1 Unlawful killing without intent to kill. It can be voluntary (such as a deadly fist fight) or involuntary (such as an accident caused by a speeding car).

2 An act of killing a human being unlawfully but not willfully (as opposed to murder)

3 Manslaughter is a legal term for the killing of a human in a manner considered by law as less culpable than murder.

4 is the killing of a human being, but without the type of intent required for murder

and so on

So icy roads middle of day lots of car, then when do you turn siren on ?

Meredith Heller, McIntosh's sister, said: "I guess Ray Morrogh finds a momentary lapse of judgment, which resulted in an officer killing my sister, acceptable. Whereas I, as a citizen, cannot. I would be curious to know, if the roles were reversed, what charges would my sister have faced."

In Florida, even with lights on, emergency vehicles must slow at a red light to ensure green side traffic has stopped and sees the vehicle.  We did a hypothetical case on this last semester.  It's a darn shame all the way around.  If the training was what has been implied, then the verdict was correct.  Wrong, but correct.

Basically, a call for service is the generic name for any reactive issue the police deal with.

When someone calls and asks for the cops it is a "call for service"

Whether it was false or not is irrelevant.
It wasn't a life or death call.
